HomeMy WebLinkAbout10838 RES - 05/03/1972Ir JRR;e;5 /3/72;lst ► ;'3 A RESOLUTION ADOPTING HIGHWAY COMMISSION MINUTE ORDER NO. 66090, DATED APRIL 3, 1972, REGARDING THE RECONSTRUCTION OF PAVEMENT AND ITS SUPPORT ON AYERS STREET, EXTENDING FROM PORT AVENUE TO NORTON DRIVE, A DISTANCE OF APPROXIMATELY 0.9 MILE, SUCH AYERS STREET BEING INCLUDED IN THE FEDERAL -AID METROPOLITAN SYSTEM; ALL AS IS MORE FULLY SET OUT IN SAID MINUTE ORDER, A COPY OF WHICH IS ANNEXED HERETO AND MADE A PART HEREOF FOR ALL PERTI- NENT PURPOSES; AND DECLARING AN EMERGENCY. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Minute Order No. 66090, passed and approved by the State Highway Commission on April 3, 1972, regarding the reconstruction of pavement and its support on Ayers Street, extending from Port Avenue to Norton Drive, a distance of approximately 0.9 mile (Ayers Street being included in the Federal -Aid Metropolitan System), be, and the same is hereby adopted by the City of Corpus Christi, Texas. SECTION 2. The necessity to adopt Minute Order No. 66090 at the earliest practicable date creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this Resolution be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED, this the 3rd day of 72. TKEREFORE, the State highway Engineer is directed to tender the following pro- posal to the City of Corpus Christi for the development of such a project: PrAided the City will: 1. Provide for the construction of curb and gutter, storm sewers, driveways, sidewalks, the adjustment of utilities, etc., all as may be necessary for a complete project with the exception of pavement and its support. 2. Provide for the Reconstruction of Pavement and its support, at an estimated coot of $408,000, subject to the aligibility of the proposed wort: for financing wiL•h Federal Metropolitan Funds. Upon acceptance of the provisions of this Order by the appropriate officials of the City of Corpus Christi, IT IS ORDERED that Ayers Street; extending from the old location of State Ilighvay 286 at Port Avenue, Northeast to Norton Drive., a distance of approximately 0.9 mile, be and is hereby designated as a METROPOLITAN HIGHWAY, and the State Ilighwny Engineer is directed to enter into agreement with the City uuvering the details of the proposed improvements, and after the City has fulfilled its responsibilities, proceed with Reconstruction in the most feasi- ble and economical manner, financing the cost in the Federal Metropolitan Program. It is understood that the City may discharge its construction obligations as out- lined herein in any manner as they may elect. In the event the City desires the - -Sto,Ge - to =inc -lude- their --portion of -the work in the-State's construction contract, the State Highway Engineer is hereby authorized to enter into agreement with the City for ouch work and its cost as may be agreed upon. This Order shall become operative upon acceptance by the City of Corpus Christi and if not accepted within 90 days of the date hereof, the action'horein con- tained Shall be automatically cancelled.
