S. DEPARTMENT OF INTERIOR, BEFORE THE TEXAS WATER RIGHTS COMMISSION, ALL IN ACCORDANCE WITH THE ATTACHED APPLICATION WHICH IS MADE A PART HEREOF THE SAME AS IF WRITTEN HEREIN; AND DECLARING AN EMERGENCY. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. THAT THE CITY MANAGER BE AND HEREBY IS AUTHORIZED AND DIRECTED TO SIGN AND EXECUTE THE APPLICATION OF THE CITY OF CORPUS CHRISTI, TEXAS, FOR DESIGNATION AS COOPERATING LOCAL SPONSOR ON NUECES RIVER PROJECT, TEXAS, AS PROPOSED BY BUREAU OF RECLAMATION, U. S. DEPARTMENT OF INTERIOR, BEFORE THE TEXAS WATER RIGHTS COMMISSION, AUL IN ACCORDANCE WITH THE ATTACHED APPLICATION WHICH IS MADE A PART HEREOF THE SAME AS IF WRITTEN HEREIN; SECTION 2. THE NECESSITY TO EXECUTE THE FOREGOING APPLICATION CREATES A PUBLIC EMERGENCY AND IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PAS. S. DEPARTMENT OF THE INTERIOR i TO THE HONORABLE TEXAS WATER RIGHTS COMMISSION:• Now comes the City of Corpus Christi, Texas, and presents this application pursuant to Section 11.252, Texas Water Code, and Rule 660.1, Rules, Regulations and Modes of Procedure of the Texas Water Rights Can- mission, for designation as the cooperating local sponsor for the develop- ment of the Nueces River Project, Texas, as proposed by the Bureau of Reclamation, U. S. Departwnt of the Interior, in its Feasibility Report on the project, dated July, 1971. I. Purposes of the Project The Nueces River Project, Texas, will be a multiple- purpose reservoir on the Nueces River, Nueces River Basin, in Nueces, San Patricio and Jim Wells Counties. The purposes of the project will be primarily to provide a regional municipal and industrial water supply for the Coastal Bend Area of _ Texas, centering around Corpus Christi, Texas. Additional purposes which the project will serve are public recreation and sport- fishing. • II. • Reasons for the Application The reasons the City of Corpus Christi makes this application are: 1. There is an urgent need for the project to move forward as expeditiously as possible, and the early designation of the City as the local sponsor would serve that end. The City will not object to the concurrent i! designation of the Texas Water Development Board as a joint - cooperating local sponsor with the City should the Texas Water Development Board desire to be so designated. 2. The City has the necessary legal authority to participate in the construction and operation of the project as proposed in the Feasibility Report and to assume the obligations and responsibilities imposed by Federal and State laws and regulations on a local sponsor. c 3., The City has been intimately involved in the developments of this project since its inception and will act for all project water users in ob- taining the necessary water rights and in executing the necessary repaynent contracts. The City will contract with other project water users to assure them of equitable and appropriate shares of the project water supply under the supervision of the Texas Water Rights Commission. - Contemplated Use of Water The proposed reservoir will impound 986,600 acre -feet of water. There will be no flood control storage. The estimated dependable yield of the conservation storage in the reservoir is 173,000 acre -feet per year. The City will make application to the Texas Water Rights Ccnaission at the , IF NECESSARY appropriate time for a permit /to appropriate the full 175,000 acre -feet of yield a year for municipal and industrial purposes. In addition, the water will be used in place in the reservoir for recreational purposes under a : recreational development program explained in the Feasibility Report. IV. Applicant's Contributions to the Project ~+ The City has made and will continue to make contributions of its personnel, facilities, finances, and other resources available to it to further the planning and development of the project: Specifically, the City will: 1. Take the necessary actions for all project water users to obtain in the City's name the water rights required for project operation. 2. Execute contracts with other project water users to assure them of equitable and appropriate shares of the project water supply under the super- vision of the Texas Water Rights Commission. 7. 2 3. To call an election to authorize and to execute a contract, if so authorized at said election, obligating itself to repay to the"Uni.ted States reimbursable water supply costs of the Nueces River Project and to assume responsibility for operation and maintenance of the project after completion of construction, including payment of operation, maintenance, and replacement costs allocated to water supply. 4. 9b call an election to authorize and to execute a contract, if so authorized at said election, obligating itself to repay to the United States reimbursable recreation and fish and wildlife costs of the Nueces River Pro- ject recreation and sport- fishing facilities, including payment of operation, maintenance, and replacement costs of those facilities. 5. provide any other services and take any other actions required by appropriate Federal and State laws and regulations to accmTplish the project. In addition, the City will participate and cooperate with all Federal, State and local agencies having any interest in or responsibility for the project. Prayer The City requests that this application be set for consideration by the Texas Water Rights Commission at the earliest appropriate time. The City requests that upon hearing, the Commission designate the City of Corpus Christi, Texas, as the cooperating local sponsor for the development of the Nueces River Project, Texas, and enter such order or orders as may be appropriate.
