HomeMy WebLinkAbout10881 ORD - 05/24/1972JRR:vmp 5/24/72 :1st AN ORDINANCE CLOSING AND ABANDONING TWO EASEMENTS LOCATED IN TRACTS "B" AND "C" OF COUNTRY CLUB ESTATES SECTION 1; AND DECLARING AN EMERGENCY. WHEREAS, there exists two 7.50 foot wide utility easements in Tracts "B" & "C" of Country Club Estates Section 1, as shown by .map filed in Volume 28, page 49 of the Map Records of Nueces County, Texas; and WHEREAS, the aforesaid easements are not now needed by the City, nor will they within the foreseeable future be needed by the City of Corpus Christi for any purpose whatsoever; and WHEREAS, it has been determined that it is to the advantage of the City to abandon the easements hereinabove described so that the same may be used by the owners of the abutting property for other purposes and increment the values of the City's ad valorem tax rolls: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the two 7.50 foot utility easements which are located in Tracts "B" and "C" of Country Club Estates Section 1, in the City of Corpus Christi, Nueces County, Texas, be, and the same are hereby, closed and abandoned for public use and every municipal purpose and abandoned to the owners of the abutting property, in accordance with the laws of the State of Texas and for the service and interest of the inhabitants of the City of Corpus Christi. The two 7.50 -foot easements are more fully de- scribed as follows: FIELDNOTES for a 7.50 foot wide easement for utilities proposed to be abandoned contiguous with a portion of the northerly boundary line of Tract C of Country Club Estates., Section 1 Tracts A, B and C as recorded by map filed in volume 28 Page 49 of the map records of Nueces County, Texas: BEGINNING at a point in the northerly boundary line of Tract C for the northeast corner and POINT OF BEGINNING of this tract whence the most northerly northeast corner of Tract C bears with said boundary line N 38° 58' 26" E 126.03 feet; THENCE continuing with said boundary line S 381 58' 26" W 37.78 feet to a corner of said Tract C and a corner of this tract; THENCE in a westerly direction with said boundary line, a circular curve to the left whose radius center bears S 12° 48' 47" W 730.37 feet and having a central angle = 15° 55' 42 ", tangent = 102.18 feet, for an arc distance of 203.04 feet to the northwest corner of this tract; JRR:vmp 5 /24/72:lst and THENCE radial with said curve S 31 06' 55" E 7.50 feet to the southwest corner of this tract; THENCE in an easterly direction with a circular curve to the right whose radius center bears S 30 06' 55" E 722.87 feet and having a central angle = 16° 17' 54 ", tangent = 103.51 feet, for an arc distance of 205.63 feet to the southeast corner of this tract; THENCE N 38° 58' 26" E 42.47 feet to the most easterly corner of this tract; THENCE N 51° 01' 34" W 7.50 feet to the POINT OF BEGIN- NING; FIELDNOTES for a 7.50 foot wide strip of land for utility easement proposed to be abandoned situated in Tract B of Country Club Estates Section 1 Tract A, B and C shown by map recorded in Volume 28 Page 49 of the map records of Nueces County, Texas: BEGINNING at a point in the southerly right -of -way line of Woolridge Road, the northeast corner of Tract B, for the northeast corner and POINT OF BEGINNING of this tract; THENCE with the east boundary line of Tract B S 270 41' 31" W 180 feet to the southeast corner of this tract; THENCE N 620 18' 29" W 7.50 feet to the southwest corner of this tract; THENCE N 270 41' 31" E 179.16 feet to the southerly right - of -way line of Woolridge Road for the northwest corner of this tract; THENCE along said right -of -way line S 680 41' E 7.55 feet to the POINT OF BEGINNING. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easement creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having -2- JRR:vmp 5/24/72:1st declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 417 day of May, 1972.
