HomeMy WebLinkAbout10889 ORD - 05/31/1972JRR:ml:5- 26- 72;1st " 4 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE A REAL ESTATE CONTRACT WITH SEASIDE MEMORIAL PARK ASSOCIATION, INC., FOR THE ACQUISITION OF PARCEL NO. 2, AIRLINE ROAD IMPROVE- MENTS RIGHT -OF -WAY, SOUTH ALAMEDA STREET TO OCEAN DRIVE, APPROPRIATING OUT OF THE NO. 220 STREET BOND FUND $10,162 OF WHICH $10,000 IS FOR THE ACQUISITION AND $162 IS FOR CLOSING COSTS AND INCIDENTAL EXPENSES, ALL APPLICABLE TO PROJECT NO. 220 -70 -119; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: q SECTION 1. The City Manager be, and he is hereby, authorized to execute a real estate sales contract with Seaside Memorial Park Association, Inc., for the acquisition of Parcel No. 2, Airline Road Improvements Right - of Way, south Alameda Street to Ocean Drive; Project No. 220 -70 -119, said parcel being described as follows, respectively: Being a 0.036 acre tract out of Lot 7, Section 1, Flour Bluff and Encinal Farm and Garden Tracts as shown by Map of record in Volume A, Pages 41 -43, Map Records, Nueces County, Texas, said 0.036 acre tract of land being more Particularly described by metes and bounds as follows: Beginning at the intersection of the northwest right -of- way line of original 60 feet wide Airline Road and the Northeast right -of -way line of 60 foot wide Gaines Street for the most southerly and beginning corner of the tract herein described; r Thence N. 610 04' 45" W., with the existing northeast right - of-way line of said Gaines Street, a distance of 29.27 feet to a point for the most westerly corner of the tract herein described; Thence in an easterly direction with the arc of a curve to the left whose central angle of 890 56' 45" and whose radius is 20.0 feet, a distance of 15.70 feet to a point the P. C. _ C. of curves; Thence in• a northeasterly direction with th'e arc of a curve to the right whose central angle is 20 20' 28" and whose radius is 1296.93, a distance of 52.99 feet to a point, the point of tangency of said curve; Thence N. 310 18' 58" E., a distance of 138.80 feet to a point for the P. C. of a curve; Thence in a northeasterly direction with the arc of a curve to the left whose central angle is 20 20' 28 ", and shose radius is 2979.38 feet, a distance of 121.74 feet to a point in the existing northwest right of way line of original 60 foot wide Airline Road; i..a. Thence S. 280 58' 30" W., with the existing northwest right -of -way line of said Airline Road, a distance of 333.34 feet to the point of beginning. Containing 0.036 acre of land more or less. SECTION 2. There is hereby appropriated out of No. 220 Street Bond Fund the sum of $10,162, of which amount $10,000 is for land purchase and $162 is for closing costs and incidental expenses, all in connection with Project No. 220 -70 -119, Parcel No. 2, Airline Road Improvements Right- of-Way South Alameda Street to Ocean Drive. SECTION 3. The necessity to authorize the execution of the necessary documents and to authorize the payment "of funds for the acquisition of the aforesaid parcel of land as soon as possible creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect.and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 31,0- day of May, 1972.
