AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE FIVE UTILITY
EASEMENTS, BEING PARCELS NO. 1, 5, 7, 2 AND 4, PROJECT
NO. 251- 70 -8o, CLARKWOOD AND SAN JUAN SANITARY SEWER
PROJECT; APPROPRIATING THE SUM OF $549 OUT OF NO. 251
BOND FUND FOR THE ACQUISITION OF THE AFORESAID PARCELS
FROM THE OWNERS T. C. ISENSEE, CHRISTOPHER ISENSEE,
CAROL I. KILGORE AND ANNA C. ISENSEE; AND DECLARING
'AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRIST4,-,'

SECTION 1. THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED
TO EXECUTE FIVE UTILITY EASEMENTS, BEING PARCELS No. 1, 5, 7, 2 AND 4,
PROJECT NO. 251- 70 -80, CLARKWOOD AND SAN JUAN SANITARY SEWER PROJECT,
SAID PARCELS BEING DESCRIBED AS FOLLOWS:
PARCEL No. 1'
Being a 10 foot by ?_031.3 foot strip of land out of Shares 3 and 4, of the
Isensee Partition as described in Partition Deed in Volume 317, Pages 248-
253, Nueces County, Texas Doed Records, said Shares 3 and 4, later deeded to
Carol hilgorc, T. C. Isensee, and Chris Ii. Isensee by deed recorded in Volume
587, Pages 291, I,ueces County, Texas Deed Records, said strip of land being
more particularly described by metes and bounds as follows:
Beginning at a point in the west right of way line of Clarkwood Road, at its
intersection v th the northeast corner of a 2.0 acre tract of land described by
deed to Fred Doehne, in Vol-le 336, Page 9, Deed Records, Nueces County, Texas
.for the Southeast and beginning corner of the tract herein described;

of 1135.0 feet to a point, being the Northwest corner of said 2,0 acre tract, for

Thence N. 89 0 20' 15" E., with a line that is 10.0 feet north of and parallel to
the P;orLh line of said 2.0 acre tract, a distance of 435.02' feet to a point in th
west right of vay line of said Clarkwood Road for the Northeast corner of the trac
herein described;
Thence due South with the west right of way line of said Clarkwood Road, a distanc
of 10.0 feet to the point of be,-,inning.
Containing 0.1178 acre of land more or less.
Together with and in addition to said 10 foot utility easement, a temporary 30
fool construction Easement adjacent to and 1lorth of the above described utility
eascmcnL. Said casement to slur for a period equal to the term of the construction

PARCEL No. 5:
Being a 30 foot l!icle by 397.2 foot Ion utility easement out of Survey No. 1104,
and out of that certain 300.4 acre tract of land described in Volume 87, Page 299,
Deed Records, 'teces County, Texas and more specifically out of that 9.85 acre
tract of .Land described in Volu'nc 796 Page 377, Deed Records, ;lueces County, Texas,
said utility easement being more particularly described by metes and bounds as
follows:
Beginning at the northeast corner of said 9.85 acre tract of land and the northwest
corner of the Clarkwood Independent School District Tract described in Volume 437,
Pagc 195, Deed Pecords, Nueces County, Texas, for the northeast corner of the tract
herein described; _
Thence clue South, t-rith the best line of said School tract and with the east line
of said 9.85 acre tract, a distance of 1100 feet more or less to a point in the
Northeast right -of -way line of a 50 foot wide drainage easement for the Southeast
corner of the tract herein described;
Thence in a northwesterly direction with the northeast boundary line of said 50 foot
wide drainage easement, a distance of 111.0 feet more or less to a point that is 10
feet west of measured at right angle to the east line of'said 9.85 acre tract for
the Southwest corner of the tract herein described;
Thence clue North, with a line that is 10 feet west of and parallel to the east line
of said 9.85 acre tract, a distance of 397.2 feet to a point in the north line of
said 9.85 acre tract for the northwest corner of the tract herein described;
Thence clue cast, with the north line of said 9.85 acre tract, a distance of 10.0
feet to the point of bc,,inning.
Containing 3986 square feet of land more or less.

Doing a 1.0 foot wide by 350 feet long, strip of land out of State Survey No.
404, and also beinU a part of the tract of 99.76 acres of land conveyed and
set aside to liugo T. lsensee and designated Share NO. 3 in a partition of
approxi;:iatcly 68303 acres of land which vas partitioned by said Hugo T. Isensee
and his six brothers end sisters by a partition deed dated December 8, 1945,
and which is of record in Volume 317, Page 248, Decd Records, Iiueces County,
Texas, said strip of .land being more particularly described by metes and bounds
as follows :
Beginning at a point in the northwest corner of a certain 2.11 acre tract of
land in the name of Clarkwood Lwdber Company, described in Volumc 329, Page
-367; Decd Records, i {ucces County, Texas for the Northeast and beginning corner
of the tract herein described;
Thence due South, with the west boundary line of said 2.11 acre tract, a distance
of 350 feet to a point in the north right -of. -way line of the Texas - Mexican
Railroad Company for the Southeast corner of the tract herein described;
Thence S. 89° 20' 15" 1•l., with the north right -of -way line of said Texas- Alcxican
Railroad Company, a distance of 10.0 feet -to a point for the Southwest corner of
the tract-herein described;
Thence due north, vrith a line that 10 feet west of and parallel to the west line.
of said 2.11 acre tract, a distance of 350,89 feet to a point for the northwest
corner of the tract herein described;
Thence S. 850 33' 37" E., a distance of 10.03 feet to the point of beginning,;
Containing 3504.5 square feet of land more or less.
Together with and in addition to said 10 foot utility casement, a temnorary
30 foot Construction 3asement adjacent to and west of the above described
utility casement. Said easement to run for a period equal to the term of the
construction.

for all purposes.
PARCEL NO. 2:
Being a 1.0 foot by 1.087.0 foot utility easement out of Survey 404, and out of that-
certain 300.4 acre tract of land described in Volume 87, rage 299, Deed Record,
P7ueces County, Texas, said easement being more particularly described by metes
and bounds as follows:
Beginning at a point in the South right -of -way line of State highway No. 44,
said point being S. 890 20' 15" W., 1285.0 feet and South 50.0 feet from the
intersection of said South right -of -way line of State Highway No. 44, and the
west right -of -way line of Clarkwood South Road, for the Northeast and beginning
corner of the tract herein described;
Thence due South, a distance of 187.2 feet to a point for an interior corner of
the tract herein described;
Thence N. 890 20' 15" E., a distance of 707.0 feet to a point in the west line of
that certain 0.81 acre tract of land described in Volume 231, Page 250, Deed Records,
Nueces County, Texas for a corner of the tract herein described;
Thence due South, with the west line of said 0.81 acre tract, a distance of 202.8
feet to a point, the northwest corner of the Clarkwood Independent School District
tract as described in Volume 437, Page 195, Deed Records, Nueces County, Texas, for
the Southeast corner of the tract herein described;

Page 377, Deed Records, Nueces County, Texas, a distance of 10.0 feet to a point
for the Southwest corner of the tract herein described;

line of.said 0.81 acre tract, a distance of 192.8 feet to a point for an interior
corner of the tract herein described;
Thence S. 890 20' 15" W., a distance of 707.0 feet to a point for a corner of the

Thence due North, a distance of 197.2 feet to a point in the South right -of -way
line of said State highl•:ay No. 44, for the most northerly northwest corner of the
tract herein described;
Thence N. 890 20' 15" F., with the South line of said State highway No. 44, a

Containing 10,870 square foot of land more or less.

Being a 30 foot wide by 1147.0 foot long construction Easement out of Survey
404, and out of a certain 300.4 acre tract as described by deed in Volume 87,
Page 299, Nueces County, Texas, Deed Records, said Construction Easement being
more particularly described by metes and bounds as follows:
Beginning at a point in the South right of way line of State highway No. 44,
said point being S. 890 20' 15" W., 1255.0 feet from its intersection with
the west right -of -way line of 100 foot sri.de Clarkwood South Road, for the
Northeast and beginning corner of the tract herein described;
Thence due South, a distance of 207.2 feet to a point for an interior corner
of the tract herein described;
Thence 11. 890 20' 15" E., at 677.0 feet pass the west line of a certain 0.81
acre tract of land described by Volume 231, Pa .ae 250, Deed Records,' Nueces
County, Texas, in all a distance of 707 feet to a point for a corner of the
tract herein described;
Thence due South, with a line that is 30.0 feet east of and parallel to the
west line of said 0.81 acre tract, a distance of 232.8 feet to a point in the
North boundary line of the Clarkeood Independent School District Tract for a
corner of the tract herein described;
Thence due West, with the north line of said school tract, a distance of 30.0
feet to its riorthwest corner thereof for the Southwest corner of the tract
herein described;
Thence due North, with the rest line of said 0.81 acre tract, a distance of
202.8 feet to a uoint for an interior corner of the tract herein described;
Thence S. 89 0 20' 15" W., a distance of 707.0 feet to a point for the South -

SECTION 2. THERE IS HEREBY APPROPRIATED OUT OF THE NO. 251 BOND
FUND THE SUM OF $549 FOR THE ACQUISITION OF THE AFORESAID PARCELS FROM
T. C. ISENSEE, CHRISTOPHER ISENSEE, CAROL I. KILGORE AND ANNA C. ISENSEE,
OWNERS.
SECTION 3. THE NECESSITY TO AUTHORIZE THE EXECUTION OF THE SAID
EASEMENTS AND TO APPROPRIATE THE NECESSARY SUMS FOR THE ACQUISITION THEREOF
IN ORDER THAT THE SANITARY SEWER IMPROVEMENT PROJECT MAY PROGRESS WITHOUT
DELAY CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY
REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION
SHALL BE= PASSED FINALLY ON THE DATE-OF ITS INTRODUCTION BUT THAT SUCH
ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY
COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO
EXIST, AND .HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT
THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE
EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS
ACCORDINGLY SO ORDAINED, THIS THE ..L � DAY OF JUNE, 1972.
