HomeMy WebLinkAbout10947 ORD - 06/28/1972JRR:HG:jkh; 6- 28 -72; 1st TEXAS: AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY 14ANAGER TO EXECUTE A CONTRACT FOR LEASE FROM THE BISHOP CONSOLIDATED INDEPENDENT SCHOOL DISTRICT FOR THE LEASE OF A PASSENGER BUS FROM JUNE 28, 1972 TO AUGUST 4, 1972 FOR TRANSPORTING CHILDREN IN SUMMER RECREATIONAL ACTIVITIES, AS MORE FULLY SET FORTH IN THE LEASE CONTRACT, A COPY OF WHICH IS ATTACHED HERETO AND MARKED EXHIBIT "A "; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized to execute a contract for lease from the Bishop Consolidated Independent School District for the lease of a passenger bus from June 28, 1972 to August 4, 1972 for transportation of children in summer recreational activities, as more fully set forth in the lease contract, a copy of which is attached hereto, marked Exhibit "A ". SECTION 2. The necessity to immediately authorize the execution of the aforesaid lease contract creates a public emergency and an impera- tive public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduc- tion but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity exist, and having requested the suspension of the Charter rule, and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ay of, 1972. ATTEST: d City Secre �YOR THE CITY 0 CORP C ISTI, TEXAS APPROVED: DAY OF_V (&h C , 1972: C(it /Attdrney 10947 i4­ JRR :HG:jkh; 1st 6 -28 -72 C O N T R A C T THE STATE OF TEXAS X COUNTY OF NUECES X On this the day of , 1972, the City of Corpus Christi, hereinafter called "City ", a home rule city, municipal corporation and body politic under the laws of the State of Texas, and Bishop Consolidated Independent School District, hereinafter called "District ", do both covenant, agree and contract as follows: 1. That District will lease to City a 1957 Chevrolet, sixty -six (66) passenger school bus, Identification No. 8F57W107863, Texas 1972 Registration No. 2. The term of this lease shall be from June 28_1972 thru 12:00 o'clock midnight, August 4, 1972 3. The leased vehicle shall be used for the purpose of trans- porting children. 4. City shall pay the sum of Thirty Cents ($.30) per mile, which includes gas, oil, and all operating expenses except insurance for each mile that shall show to have been driven on the mileage meter of said vehicle up to the return of such vehicle to District. 5. That City shall be responsible for repair and maintenance of said vehicle due to negligence and shall return the same to District in the same condition as it was at the signing of this contract, except for normal wear and tear. 6. City accepts the bus on an "as is" basis. 7. City agrees to indemnify and forever hold harmless District against each and every claim, demand or cause of action that may be made or come against District by reason of or in any way arising out of the lease and use of said vehicle. 8. City agrees to maintain adequate public liability insurance on said vehicle, insuring passengers as well as nonpassengers and property damage. JRR:HG:jkh; 1st 6 -28 -72 9. That said vehicle shall be returned to District after the termination of this agreement at a place designated by District in the City of Bishop, Texas. Executed this the day of , 1972.
