HomeMy WebLinkAbout10955 ORD - 07/05/1972JRR:m1:7- 3- 72;lst 0 MY�►:I:�`i7 AN ORDINANCE AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT WITH SARATOGA LAND COMPANY, DEVELOPERS OF COUNTRY CLUB ESTATES, UNIT 14, FOR THE CONSTRUCTION OF CURBS, GUTTERS, SIDEWALKS AND ONE HALF OF THE STREET PAVEMENT ABBUTTING THE PUBLIC PARK IN COUNTRY CLUB ESTATES UNIT 14, AS MORE FULLY SET FORTH IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "A "; APPROPRIATING OUT OF THE NO. 220 STREET BOND FUND $5,343.42, OF WHICH $4,970.62 IS FOR CONSTRUCTION AND $372.80 IS FOR ENGI- NEERING, ALL APPLICABLE TO PROJECT NO. 220 -70 -131; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be and he is hereby authorized and directed to enter into an agreement, for and on behalf of the City of Corpus Christi, with Saratoga Land Company pertaining to the Company's obligation for the construction of curbs, gutters, sidewalks and one half of the street pavement abutting the Public Park in Country Club Estates Unit 14, all as is more clearly set forth in the attached copy of Agreement, marked Exhibit "A ", which is made a part hereof by this reference. SECTION 2. That there is hereby appropriated out of 220 Street Bond Fund the amount of $5,343.42, of which $4,970.62 is for construction and $372.80 is for engineering, all applicable to Project No. 220 -70 -131. SECTION 3. The necessity to authorize the above referenced con- tract and appropriate the necessary funds to cover the City's obligation in the above project creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, ToI>/ this the 5C, day of date, 1972. WSecre d YOR THE CITY OF (ORP ISTI, TEXAS D: DA 0 , City At o ney� �- 7 • ®955 AGRrEM.4 • TIIL STATL Or TMAS COUNTY Or NUECLS This agreement is authorized by Ordinance No. and is entered into between the City of Corpus Christi, Texas, ( "Party of the First Part ") hereinafter called "City ", and Saratoga Land Company ( "Pasty of the Second Part ") being referred to as "Developer ", and pertains to the City's share of the cost for improvements when City participation is set forth in the Platting Ordinance and for improvements required by the City over and above those set forth in the Platting Ordinance in the development of Country Club Estates Unit 14 NOW, TIiERIT ORE, the City and the Developer agree as follows: 1. The Developer will construct curb gutter,.sidezvalk and one half the pavement abuttin the ark alon Ro alton Drive This construction will be contracted for and financed by the Developer. 2. The City agrees to reimburse the Developer as its share for the cost of the above stated construction, including engineering, the sum of Five thousand three hundred fort three and 42� 100 Dollars ($5,343 42)• Such reimbursement will be made by the City to the Developer upon completion and acceptance of the improvements by the City. 3• The Developer agrees to indemnify the City against any claims arising as a result of the project. I+• This agreement shall be executed in duplicate, both of which shall be considered one instrument. When both of the duplicates have been executed by the City, and at least one duplicate has been executed by the Developer, this agreement shall become effective and shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors and aesi�s.
