Home My WebLink About10957 ORD - 07/05/1972JRR:m1:7- 5- 72;1st AN ORDINANCE F A14C NDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING SECTION 16 -101 LICENSE TO SELL OR DISTRIBUTE - CLASSES AND FEES; PROVIDING FOR ISSUANCE OF FISH WHOLESALER'S LICENSE, FISH RETAILER'S LICENSE, AND WHOLESALE FISH PEDDLER'S LICENSE BY THE DIRECTOR OF FINANCE UPON PROPER APPLICATION; PROVIDING A FEE OF TWENTY -FIVE ($25) DOLLARS PAYABLE CASH IN ADVANCE FOR A FISH WHOLESALER'S LICENSE; PROVIDING A FEE OF FIFTEEN ($15) DOLLARS PAYABLE CASH IN ADVANCE FOR A FISH RETAILER'S LICENSE; PROVIDING A FEE OF ONE HUNDRED ($100) DOLLARS PAYABLE CASH IN ADVANCE FOR A WHOLESALE FISH PEDDLER'S LICENSE; PROVIDING CERTAIN TERMS AND REQUIREMENTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Corpus Christi City Code, 1958, as amended, be and the same is hereby, amending Section 16 -101, License to Sell or Distribute - Classes and Fees, to hereafter read as follows: b; "Section 16 -101. Same - Classes and Fees. There shall be three classes of licenses required by the preced- ing section as follows: Fish Wholesaler's License. The Director of Finance may, upon proper application, issue to any person what shall be known as a "fish wholesaler's license ", upon the payment by the applicant to the Director of Finance of a license fee of Twenty -Five ($25) Dollars payable in cash in advance, and accompanied by affidavit that the person desiring the license shall maintain and operate a fixed and definite place of business located in the City. Under the terms of such a license, the holder shall not be allowed to peddle from store to store, but his sales must be made ' directly, either by delivery upon a previously executed order or directly from his place of business. Fish Retailer's License. The Director of Finance may, upon proper application, issue to any person what shall be known as a "fish retailer's license ", upon the payment by the applicant to the Director of Finance of a license fee of Fifteen ($15) Dollars, payable in cash and in advance, and accompanied by affidavit that the person desiring the license shall maintain and operate a fixed and definite place of business located in the City. Under the terms of such a license, the holder shall not be allowed to peddle, from store to store or from house to house, or upon the streets of the City, but his sales must be made directly, either by delivery upon a previously executed order or directly from his place of business, ILG9757 y � Wholesale Fish Peddler's License. The Director of Finance may, upon proper application, issue what is known as a "wholesale fish peddler's license ", upon the payment of cash in advance of the sum of One Hundred ($100) Dollars, which license shall allow the licensee to sell directly from his truck, automobile, carriage or other vehicle to retail merchants in the City. Any such person who may sell directly from a truck, automobile, carriage or other vehicle to retail merchants in the City shall pay an additional One Hundred ($100) Dollars for a license for each additional truck, automobile, carriage or other vehicle carrying or displaying fish, oysters, shrimp and other marine products,-from which sales are made directly to retail merchants in the City. A fee shall not be charged for cars, trucks or other vehicles used to deliver merchandise previously ordered." SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance sha11 be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing'the caption of this ordinance, stating in substance the prupose of the ordinance. SECTION 4.
