HomeMy WebLinkAbout10971 ORD - 07/19/1972JRR:jkh :7- 14 -72; 1st TEXAS: AN ORDINANCE APPROPRIATING OUT OF NO. 291 PARK BOND FUND THE SUM OF $12,860 FOR AWARD OF SPECIAL COMMISSIONER, FEES FOR SPECIAL COMMISSIONERS, APPRAISAL COSTS, COURT COSTS AND COSTS INCIDENTAL TO ACQUISITION OF PARCEL 25B, BAYFRONT OPEN SPACE PARK SITE113, PROJECT NO. 291 -70 -8; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. There is hereby appropriated out of No. 291 Park Bond Fund the sum of $12,860 for Award of Special Commissioners, fee of Special Commissioners, appraisal costs, court costs and costs incidental to acquisition of Parcel 25 -B, Bayfront Open Space Park Site #3, being a parcel or tract of land owned by Paul Hamon and wife, Dorothy Hamou, more fully described hereinafter, and being Cause No. 654, in condemnation proceedings in County Court at Law No. 2: A tract of land located in the City of Corpus Christi, Nueces County, Texas, lying between Ocean Drive and the waters of Corpus Christi Bay; bounded on the north by an eastward extension of the north line of Lot "A" of a re- plat of a portion of Lots 5 and 60, Lots 6 through 12, and Lots 53 through 59, Block 15, Port Aransas Cliffs, as shown by said replat recorded in Volume 27, page 44, Map Records, Nueces County, Texas; and on the W. by the E., boundary line of Ocean Drive as presently located, and being described by metes and bounds as follows, to -wit: Beginning at a point on the E. line of Ocean Drive at the intersection of the E. line of Ocean Drive with the easterly extension of the original S. line of Lot 5, Block 15, Port Aransas Cliff, as shown by map recorded in Vol. "A ", page 27, Map Records of Nueces County, Texas; thence with the Easterly extension of said S. line N. 58 deg. 54' E. 190' to the seawall on the waters edge of Corpus Christi Bay; thence, generally in a northerly direction with the meanders of Corpus Christi Bay to an intersection with the easterly extension of the N. line of Lot "A" of the W. Rinehart Miller Survey as recorded in Vol. 27, page 44, Map Records of Nueces County, Texas; thence S. 58 deg. 54' W. with said easterly extension of the N. line of Lot "A" to the intersection with the E. line of Ocean Drive; thence, S. 10 deg. 53' E. along and with the E. line of Ocean Drive 107.87'+ to the place of beginning. SECTION 2. The necessity to make the hereinabove described appropriation at the earliest practicable date in order to take possession of the parcel aforesaid for the development of the Bayfront Open Space Park Site 113, creates a public emergency and an imperative public necessity iO971 requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the_ of July, 1972.
