HomeMy WebLinkAbout10976 ORD - 07/19/1972JRR:vmp r 7/14/72:lst AN ORDINANCE AMENDING ARTICLE ELEVEN OF THE CIVIL SERVICE RULES AND REGULATIONS, AS AMENDED, BY REPEALING THE PRESENT ARTICLE ELEVEN AND IN LIEU THEREOF ADOPTING A NEW ARTICLE ELEVEN SO AS TO PROVIDE FOR RESIGNATION FROM THE CLASSIFIED SERVICE; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERANCE; AND DECLAR- ING AN EMERGENCY. WHEREAS, the Civil Service Board has recommended that the City Council approve an amendment to the Civil Service Rules and Regulations so as to provide for filing of resignation of officers or employees from the Classified Service and to provide that unauthorized absence from work of a classified employee for three consecutive working days or more will be con- sidered as a resignation: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That, in accordance with the recommendation of the Civil Service Board, Article Eleven of the Rules and Regulations of the Civil Service Board, as amended, be, and the same is hereby, repealed in its entirety, and in lieu thereof there is hereby adopted a new Article Eleven, to hereafter read as follows: "ARTICLE XI TRANSFER, LEAVE OF ABSENCE, LAY -OFF, RESIGNATION AND REINSTATEMENT SECTION 9. RESIGNATION. The resignation of an officer or employee from the Classified Service shall be filed with the Board by the head of the department receiving same, together with reason or reasons therefor. It is further provided that the unauthorized absence from work of a classified employee for a period of three (3) consecutive working days or more will be considered by the Division Head and the Board as a resignation." SECTION 2. All ordinances or parts of ordinances in conflict here- with shall be, and are, repealed. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid :.as7s or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. The fact that the authority granted herein to the Civil Service Board is immediately necessary for the efficient administration of the classified civil service system of this City creates a public emergency and imperative public necessity requiring the suspension of the Charter rule providing that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor, having declared such emergency and necessity to exist, and having requested the suspension of said Charter rule and that this ordinance be passed finally on the date of its introduction and that such ordinance take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED.
