AN ORDINANCE
AUTHORIZING THE CITY MANAGER, FOR AND ON BEHALF OF
THE CITY OF CORPUS CHRISTI, TO EXECUTE THE FIRST
AMENDATORY CONTRACT AMENDING GRANT AGREEMENT NO.
WS- TX -06 -59 -1017 (G) FOR PROJECT WS- TX -06 -59 -1017
AND SUCH OTHER DOCUMENTS AS MAY BE NECESSARY TO
AMEND THE GRANT AGREEMENT WITH THE U. S. DEPARTMENT
OF HOUSING AND URBAN DEVELOPMENT FOR THE CONSTRUCTION
OF TRUNK MAIN (OUTFALL) AND UNDERGROUND GRAVITY STORM
SEWER COLLECTOR LINES IN THE GARDENDALE AREA OF THE
CITY OF CORPUS CHRISTI, TEXAS, AS PREVIOUSLY AUTHORIZED
BY RESOLUTION NO. 10840 PASSED MAY 3, 1972; AND DECLARING
AN EMERGENCY.
WHEREAS, the.City o£.Corpus.Christi and the.United States of
America entered into that certain Grant Agreement No. WS- TX- 06- 59- 1017(G),
dated the 7th day of April, 1972, and the Parties now desire to amend the
Existing Contract:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. The pending proposed Amendatory Contract, designated
"First Amendatory Contract Amending Grant Agreement No. WS- TX- 06- 59- 1017(G)
for Project No. WS- TX- 06 -59- 1017" is hereby approved in all respects.
SECTION 2. The City Manager of this local Public Body, in its
behalf, is hereby authorized and directed to execute said proposed Amendatory
Contract in three counterparts, and the City Secretary of this local Public
Body is hereby authorized and directed to impress and attest the official
seal of this local Public Body on each such counterpart and to forward such
counterparts as may be required to the Department of Housing and Urban
Development, together with such certified copies of the proceedings and
further documents relative to the approval and execution of the Amendatory
Contract as may be required by the Government.
SECTION 3. The shortness of time within which to comply with the
requirements of the Government for contracting with and obtaining assistance
creates a public emergency and an imperative public necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall
be passed finally on the date of its introduction and that such ordinance
or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared such emergency and necessity to exist, and
having requested the suspension of the Charter rule and that this ordinance

be passed finally on the date of its introduction and take effect and be in
full force and effect from and after its passage, IT IS ACCORDINGLY SO

FIRST AMENDATORY CONTRACT
AMENDING
GRANT AGREEMNT NO. WS- TX- 06- 59- 1017(G)
FOR PROJECT NO. WS- TX -06 -59 -1017
THIS First Amendatory Contract, made and entered into on the date
herein below specified, by and between the City of Corpus Christi (herein
called the "Applicant ") and the United States of America (herein called
the "Government "), WITNESSETH:
WHEREAS the Parties hereto entered into that certain Grant
Agreement No. WS- TX- 06- 59- 1017(G), dated the 7th day of April 1972, (herein
called the "Existing Contract"), and the Parties now desire to amend the
Existing Contract:
NOW, THEREFORE, in consideration of the mutual covenants, promises,
and representations contained herein and in the Existing Contract, the
Parties hereto agree as follows:
1. The Existing Contract is hereby amended by erscinding from
Section 1 of Part I thereof the amounts - $609,600.00 and $304,800.00
and inserting in lieu thereof the amounts. �527,600.00 and
263_,800.00 respectively.
2. The Existing Contract is hereby further amended by erscinding from Section 3
of Part I thereof the amount $2,300.00 and inserting in lieu thereof the
I amount $2,000.00. --
3., Unless otherwise indicated, all provisions hereby authorized are
effective on the date of this Amendatory Contract. �
IN WITNESS WHEREOF, the Applicant has caused this Amendatory Contract
to be:duly executed in its behalf and its seal to be hereunto affixed and
attested; and thereafter, the Government has caused the same to be duly
executed in its behalf • on the day of , 19_

FOR THE REASONS SET FORTH IN THE EMERGENCY CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCE02 OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
