HomeMy WebLinkAbout10994 ORD - 07/26/1972JRR:jkh:7- 24 -72; 1st - AN ORDINANCE AMENDING1HE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND'PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, PASSED AND APPROVED ON THE 29TH DAY OF MARCH, 1961, BY AMENDING ARTICLE 31, NEWLY ANNEXED TERRITORY, BY AMENDING SECTION 31 -5 BY ADDING THERETO A NEW SUBSECTION, TO BE NUMBERED SECTION 31 -5.08, SETTING FORTH A ZONING CLASSIFICA- TION ON A DESCRIBED TRACT OF LAND WHEN ANNEXED TO THE CITY OF CORPUS CHRISTI, SAID TRACT BEING A PORTION OF LOT 2, SECTION 12, BOHEMIAN COLONY LANDS, MORE PARTICULARLY DESCRIBED HEREINAFTER; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendments to the text of the Zoning Ordinance of the City of Corpus Christi, Texas; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City of Corpus Christi City Countil, in accordance with proper notice to the public, said public hearing having been held on July 12, 1972, at Regular Council Meeting of the City Council in the City Council Chamber of the City Hall in the City of Corpus Christi; and - WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, Pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the changes hereinafter set out. 10994 s y . -y, s i: t SECTION 2. There is hereby amended Article 31 of the Zoning Ordinance of the City of Corpus Christi, Section 31 -5, by adding thereto a new subsection, to be numbered Section 31 -5.08, to hereafter read as follows: "Section 31 -5.08. The following described tract of land shall be zoned and classified as "I -2" Light Industrial District: The northeast 495.0 feet of Lot 2, Section 12, Bohemian Colony Lands as shown by map of record in Volume A, page 48, Map Records, Nueces County, Texas, said 29.45 acre tract being more particularly described by metes and bounds as follows: BEGINNING at the intersection of the northeast boundary line of said Lot'2, and the northwest right -of -way line of 100 foot wide Weber Road, said point being in the present city limit line of the City of Corpus Christi for the most easterly and beginning corner of the tract herein described; THENCE S.29000'W., with the present city limit of the City of Corpus Christi, and with the northwest right -of -way line of said Weber Road, a distance of 495.0 feet to a point for the most southerly corner of the tract herein described; . THENCE N. 61030'45,tW., with a line that is 495.0 feet southwest of and parallel to the northeast boundary line of said Lot 2, a distance of 2,592.0 feet to a point in the south- east boundary line of Cabaniss Field for the most westerly corner of the tract herein described; THENCE N. 290001E., with the southeast boundary line of said Cabiniss Field; a distance of 495.0 feet to the most northerly corner of said Lot 21 in the present city limits of the City of Corpus Christi, for the most northerly corner of the tract herein described; THENCE 5.61030'45 "E., with the northeast boundary line of said Lot 2, and with the present city limits of the City of Corpus Christi, a distance of 2,592.0 feet to the point of beginning. CONTAINING 29.45 acres of land more or less. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 5. The necessity for making the aforesaid changes immediately for the purpose of maintaining at all times a comprehensive zoning ordinance -2- for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordi- nance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this th 6.�day 40FCORF , 1972.
