HomeMy WebLinkAbout10996 ORD - 07/26/1972JRR:e:7/26/72 .1st AN ORDINANCE AUTHORIZING THE CITY MANAGER TO CONVEY TO COMMUNITY DEVELOPMENT CORPORATION, AN INDEPENDENT NONPROFIT FOUNDATION, THE FOLLOWING DESCRIBED PROPERTIES: LOT 15, BLOCK 6, VILLA GARDENS, AND LOTS 2A & 2B, BLOCK 1, HIGHWAY VILLAGE, UPON PAYMENT OF THE CASH CONSIDERATION AS SHOWN HEREIN; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager be, and he is hereby authorized and directed to convey, on behalf of the City of Corpus Christi, the following described properties to the Community Development Corporation, an independent nonprofit foundation, upon payment of the cash consideration as shown herein: 1. Lot 15, Block 6, Villa Gardens - - - $1,400.00 (510 Villa Drive) 2. Lots 2A & 2B, Block 1, Highway Village 1,300.00 (10234 N.Harrington). SECTION 2. The necessity to convey the aforesaid parcels, for the sums designated, to the Community Development Corporation at the earliest possible date, creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this ofAr/J, 1972. 11 ° THE CITY OF JOYPUS CHRISTI, TEXAS :i09gs JRR:dp:5- 22- 72:lst SPECIAL WARRANTY DEED THE STATE OF TEXAS KNOW ALL MEN BY THESE PRESENTS: COUNTY OF NUECES X That the City of Corpus Christi, acting by and through its duly authorized City Manager, R. Marvin Townsend, for and in consideration of the sum of ONE THOUSAND FOUR HUNDRED AND N01100 DOLLARS - - - ($1,400.00) - - - - - - - - the receipt of which is hereby acknowledged, and for which no lien is retained, either expressed or implied, does hereby GRANT, BARGAIN, SELL and CONVEY unto Community Development Corporation, the following described tract or parcel of land situated 'in the County of Nueces, State of Texas: Lot 15, Block 6, Villa Gardens, an addition to the City of Corpus Christi, Nueces County, Texas, same being the property conveyed to the City of Corpus Christi under Sheriff's Deed dated January 14, 1969, recorded in Vol. 1310, Page 38, Deed Records of Nueces County, Texas. TO HAVE AND TO HOLD the above described premises, together with R all and singular the rights and appurtenances thereto in anywise belonging unto the said Community Development Corporation, its successors and assigns, forever. And the City of Corpus Christi does hereby bind itself, its suc- cessors and assigns to warrant and forever defend all and singular the said premises unto the said Community Development Corporation, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof by, through or under the City of Corpus Christi, for a period of five (5) years from the date of the execution of this Deed and that upon the expiration of five (5) years from the date of execution of this Deed, the City of Corpus Christi will be released from warranty, providing no claims have been filed in dispute of such title during that period.
