HomeMy WebLinkAbout11004 ORD - 08/02/1972JRR:HG:Jkh; 8 -1 -72; l.t AN ORDINANCE AMENDING SECTION 34 -21 OF IHE CORPUS CHRISTI CITY CODE116 AMENDED, THE POLICY OF STREET ASSESSMENTS APPLICABLE TO ALL STREET IMPROVEME�vTT,� PROJECTS IN THE CITY OF CORPUS CHRISTI, BY ADDING T SUBSECTION B THEREOF A NEW ITEM, NUMBERED 5, SO AS TO PROVIDE FOR CHURCH ASSESSMENTS; REPEALING ORDINANCE NO. 10963, PASSED AND APPROVED BY THE CITY COUNCIL ON JULY 12, 1972; PROVIDING FOR SEVERABILITY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That Section 34 -21 of the Corpus Christi City Code, as amended, the policy of street assessments applicable to all street improve- ments in the City of Corpus Christi, be and the same is hereby amended by adding to Subsection B of said Section 34 -21 a new item, numbered 5, to hereinafter read as follows: "5. Where churches abut on two streets and double frontages are indicated, then the assessment rate for the church shall be reduced to 509 of the residential rate on the street which the improvements physically side; the determination as to whether the property is siding will be depen- dent upon the actual location of improvements on the property." SECTION 2. Ordinance No. 109630 passed and approved by the City Council on July 12, 1972, be and the same is hereby repealed. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court Of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its Purpose. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. r 1-1004 i v • SECTION 5. The necessity to.amend the Corpus Christi City Code as hereinabove set forth at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or ^resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage and.publication, IT IS ACCORDINGLY SO ORDAINED, this the ,day of August, ATTEST: V Ci y Secretar r MAYOR APPRO D: THE CITY OF CGRPU CHR TI, TEXAS 1-Y DAY OF AUGUST 1972 59.
