AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT
WITH BATH AND ASSOCIATES, CONSULTING ENGINEERS, FOR
THE DESIGN OF AIR CONDITIONING FACILITIES FOR THE
POLICE BUILDING, A COPY OF WHICH, MARRED EXHIBIT "A ",
IS ATTACHED HERETO AND MADE A PART-HEREOF;'APPROPRIAT
ING AID REAPPROPRIATING OUT IOF THE NO. 102 GENERAL
FUND, ACTIVITY 3327, CODE 502, $7,400 FOR THE ENGINEER'S
FEE; AND DECLARING AN EMERGENCY.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI,
SECTION 1. That the City. Manager be, and he is hereby authorized
to execute an agreement with Bath and Associates, Consulting Engineers, for
the design of Air Conditioning Facilities for the Police Building, all as
is more fully set forth in the agreement, a copy of which, marked Exhibit "A ",
is attached hereto and made a part hereof
SECTION 2. That there is hereby appropriated and reappropriated
out of the No. 102 General Fund, Activity 3327, Code 502, the sum of $7,400
for the aforesaid professional services.
SECTION 3. The necessity to enter into the aforesaid agreement in
order that the project may he commenced at the earliest practicable date
creates a public emergency and an imperative public necessity requiring the
suspension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction but that such ordinance or
resolution shall be read at three several meetings of the City Council, and the
Mayor having declared that such emergency and necessity exist, and having
requested the suspension of the Charter rule and that this ordinance be passed
finally on the date of its introduction and take effect and be in full force
and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this

THIS AGREEMENT, made and entered into this day of
, 1972, by and between the CITY OF CORPUS CHRISTI, TEXAS, a municipal
corporation, acting herein by and through its City Manager, duly authorized to act,
hereinafter called the "City ", and Bath & Associates, Consulting Engineers, of
Corpus Christi, Texas, hereinafter called the "Engineer ".
W I T N E S S E T H:
THAT WHEREAS, the City of Corpus Christi intends to proceed with completion
of the air conditioning system at the Police Building,
AND WHEREAS, the City also intends to add one ten ton chilled water unit for
the Communication and Computer Center as well as all the electrical and mechanical
work required for the installation of the communication equipment,
AND WHEREAS, the City also desires to add one fifteen ton air handling unit,
all in accordance with the Engineers' recommendation and preliminary report previously
submitted,
NOW THEREFORE, the City and Engineer agree to do the following:
I. Phase I - Preliminary Phase
The Engineer agrees to do the following work relating to the installation of
air conditioning and communication equipment:
(1) Review the project with appropriate agency or agencies of the City
(2) Council with the City agency or agencies about the general plan and
scope of improvements
(3) Prepare preliminary schematics
(4) Develop preliminary floor plans of air conditioning housing
(5) Prepare preliminary cost estimates for the project and submit said esti-
mates to the City

IT. Phase II - Detailed Plans and Specification Phase •
The Fngineer agrees to perform the following work:
(1) Prepare from approved preliminary designs the detailed plans and speci-
fications
(2) Develop working drawings of building to large scale
(3) Make necessary field surveys required for drawing plans and specifications
(4) Prepare large scale working drawing for structural, mechanical, electrical,
plumbing, heating, and ventilating systems, air conditioning, etc.
(5) Submit large scale drawing and system to City for approval
(6) Confer with City regarding detailed plan
(7) Prepare necessary bidding information and contract documents in accordance
with City established procedure
(8) Provide City with five (5) copies of approved plans and thirty -five (35)
copies of specifications for the project.
(9) Assist City in securing bids based upon construction documents
(10) Assist the City in evaluating proposals and awarding contracts
(11) Prepare final contract documents after award of contract for the review
and approval of City
III. Construction Administration Phase
(1) Provide construction administration as set forth in General Provisions
of contract
(2) Make periodic visits to the job site to determine whether work is pro-
ceeding in accordance with the contract document
(3) Review shop drawing submitted by contractor for the project and recommend
approval to City
(4) Review laboratory reports, if required
(5) Interpret construction documents if needed to the contractor
(6) Prepare monthly construction estimate and submit to the City for payment
(7) Prepare change orders on the project and submit to City and contractor
for approval
(8) Deliver to the City all certificates of inspecting authorities, equipment
operating manuals, bonds, guarantees, and related documents
(9) Make final inspection on project with appropriate City officials and
make recommendation for acceptance
(10) Deliver to the City "As Built" Construction Drawing upon completion of
project in original reproducible form
Fee Basis
Since the work is of alteration type as well as Classification A as is indi-
cated by "Texas Society of Professional Engineers Manual of Professional Practice"
the estimated basic fee will be $7,400 or 10% of construction cost whichever is less.
Payment
For and in consideration of the services listed above the City agrees to pay
the Engineer on the following basis:
(1) Upon award of contract and completion of Phase II the City will pay
Engineer 75% of basic estimated fee or as adjusted after award.
(2) Upon completion of construction of project, Phase III, the City will
pay Engineer 25% of basic fee and will also make proper adjustments to
the fee based on final construction cost.
SCHEDULING OF WORK
Engineer agrees to complete work in accordance with the following time table:
Phase II: All design and detailed specifications shall be completed
within 30 days from the date of written authorization by the City.
TE.aMINnTION OF CONTRACT
The City shall have the option of terminating this contract at any time and
the fees of Engineer shall be the fees due for such stage or stages as are completed.

for the contract, agreement, obligation or expenditures contemplated in the
above and foregoing ordinance is in the Treasury of the City of Corpus Christi

NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
