HomeMy WebLinkAbout11026 ORD - 08/09/1972• JRR:jkh:ml:4- 28- 72;2nd • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, BY AMENDING ARTICLE 29, THE BOARD OF ADJUSTMENT, SECTION 29 -3, SPECIAL USE EXCEPTIONS, BY DELETING IN THEIR ENTIRETY SUBSECTIONS 29 -3.11 AND 29 -3.15; RENUMBERING SUBSECTION 29 -3.13 TO HEREAFTER BE DESIGNATED AS SUBSECTION 29 -3.12 AND AMEND THE SAME BY INSERTING THE WORDS "WITHIN ANY PROFESSIONAL OFFICE, BUSINESS, OR INDUSTRIAL DISTRICT" AFTER THE WORDS "PARKING AREAS" IN THE SECOND LINE, AND BEFORE THE WORDS "AREA REQUIRED BY THE PARKING REGULATIONS OF THIS ORDINANCE "; RENUMBERING THE PRESENT SUBSECTION 29 -3.12 TO 29 -3.11, AND RENUMBERING THE PRESENT SUBSECTIONS 29 -3.14, 29 -3.16, AND 29 -3.17 TO HEREAFTER BEAR THE NUMBERS OF SUBSECTIONS 29 -3.133 29 -3.14 and 29 -3.15, CONSECUTIVELY; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HERE- WITH; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning certain amendments to the text of the Zoning Ordinance of the City of Corpus Christi, Texas; and WHEREAS, public hearing was held at which hearing all persons wishing to appear and be heard were heard, to consider the same before the City Council of the City of Corpus Christi, in accordance with proper notice to the public, said public hearing having been held on March 1, 1972 and recessed until March 29, 1972, at Regular Council Meetings of the City Council in the City Council Chamber of the City Hall in the City of Corpus Christi; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would best serve the public health, necessity and convenience and the general welfare of,the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565 et seq of the Ordinance and Resolution, 1.026 I Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the changes hereinafter set out. SECTION 2. That Article 29, The Board of Adjustment. Section 29 -3, Special Use Exceptions, be amended by deleting in their entirety Subsections 29 -3.11 and 29 -3.15, and that the present Subsection 29 -3.13 be renumbered Subsection 29 -3.12 and amended to thereafter read as follows: "29 -3.12 Off- street parking areas adjacent to or at a reasonable distance from the premises on which parking areas within any Professional e Office, Business, or Industrial District are required by the parking regula- tions of this Ordinance where practical difficulties, including the acquisi- tion of property, or undue hardships are encountered in locating such parking areas on the premises and were the purpose of this Ordinance to relieve congestion in the streets would best be served by permitting such parking off the premises." That the present Subsection 29 -3.12 be renumbered to 29 -3.11, and renumbering the present Subsections 29 -3.14, 29 -3.16, and 29 -3.17 to hereafter bear the numbers of Subsections 29 -3.13, 29 -3.14 and 29 -3.15, consecutively. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 4. Publication shall be made one time in the official publication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 5. That the necessity of immediately making the aforesaid change for the purpose of maintaining at all times a comprehensive•zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared I. • W. that such emergency and necessity exist, having requested the suspension of such Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage and publication, IT IS ACCORDINGLY SO ORDAINED, this 9 day of , 1972.
