HomeMy WebLinkAbout11044 ORD - 08/23/19728/9 /72p /9/72:lst AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, 1958, AS AMENDED, BY AMENDING SECTION 5 -51, ANIMALS AND FOWL; PROVIDING FOR IMPOUNDMENT AND OBSERVATION BY THE CITY VETERINARIAN OF ANIMALS SUFFERING FROM RABIES OR SUSPECTED OF RABIES; PROVIDING THAT NO ANIMAL THAT HAS RABIES OR SUSPECTED OF HAVING RABIES SHALL BE ALLOWED IN PUBLIC PLACES, EXCEPT AS EXPRESSLY PROVIDED HEREIN; PROVIDING THAT THE OWNER, KEEPER, OR PERSON IN CHARGE OF ANY ANIMAL THAT HAS RABIES, OR DISPLAYS THE SYMPTOMS THEREOF SHALL TURN OVER SUCH ANIMAL TO THE HUMANE OFFICER OR ANY POLICE OFFICER ON DEMAND; PROVIDING THAT A REFUSAL TO TURN OVER SUCH ANIMAL SHALL CONSTITUTE A MISDEMEANOR AND UPON CONVICTION BE PUNISHABLE BY A FINE OF NOT LESS THAN $100 NOR MORE THAN $200; PROVIDING FOR DISPOSAL OF ANIMALS THAT DIE OF RABIES; PROVIDING FOR A RECORD OF RABIES AND SUSPECTED RABIES TO BE KEPT BY THE CITY HEALTH OFFICER; PROVIDING FOR PUBLICATION; PROVIDING FOR SEVERABILITY. • BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Corpus Christi City Code, 1958, as amended, be and the same is hereby amended by amending Section 5 -51, to hereafter read as follows: "Section 5 -51. Observation period, etc., for animals exhibiting symptoms of rabies. (a) Every animal that has rabies or symptoms thereof, and every animal that bites, scratches, or otherwise attacks any person with- in the City shall be impounded at once and held for observation by the City Veterinarian at the City Pound for such period of time as the City health officer may deem necessary; provided, however, that such period of time shall not be fewer than seven days nor more than fourteen days. If its owner desires, such animal may be held for observation in a private veterinary hospital approved by the City health officer at the owner's expense for the same period of time as the animal would be held for observation at the City Pound. (b) No animal that has rabies shall be allowed at any time on the streets or public ways of the City. No animal that has been suspected of having rabies shall be allowed at any time in public places, except as expressly provided herein until said animal has been released from observation by the City health officer. 11044 • JRR:vmp 8/9/72:1st • (c) The owner, keeper, or person in charge of any animal that has rabies or symptoms thereof, that has been exposed to rabies, or that has bitten, scratched or otherwise attacked any person within the City shall, on demand, turn over such animal to the humane officer, or any police officer. In the event the owner, keeper, or person in charge of such animal fails or refuses to turn over such animal on demand, such action shall constitute a misdemeanor and upon conviction be punishable by fine of not less than $100 nor more than $200. (d) The body of any animal that has died of rabies shall not be disposed of except as directed by the City health officer. (e) The City health officer shall investigate and record all cases of rabies and of suspected rabies." SECTION 2. Publication shall be made one time in the official publication of the City of Corpus Christi, after final passage, which pub- lication shall contain the caption stating in substance the purpose of the ordinance and reciting the penalty for violation of the ordinance. SECTION 3. If for any reason-any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose.
