HomeMy WebLinkAbout11045 ORD - 08/23/1972JRR:2•1,1: jkh :7- 2G -72; let AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, AS AMENDED, BY ADDING A NEW SECTION, TO BE NUMEERED SECTION 5 -39, SO AS TO PROVIDE FOR ISSUIrG NOTICE TO OWNERS OR KEEPERS OF DOGS RUNNING AT LARGE, FOR LACK OF WFUNIZATION, AND FOR LACE: OF PROPER LICENSING; PROVIDING FOR PENALTY; REPEALING ALL OP.DINANCES IN CONFLICT HEREWITH; PROVIDING FOR SEVERABILITY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. There is hereby added to the Corpus Christi City Code, as amended, a new section to be designated as Section 5 -39, hereafter reading as follows: "Section 5 -39. Issuance of Notice. In addition to, or in lieu of, impounding an animal found at large as provided in Section 5 -33 of this Code, the Humane Officer or any police officer may issue to the owner or keeper of such animal a notice of ordinance violation. Such notices may also be issued to the owners or keepers of dogs not immunized against rabies as provided in Section 5 -34 of this Code or to owners or keepers of dogs not licensed as provided in Section 5 -40 of this Code. Such notice shall - provide a space thereon for the party charged to waive trial, enter a plea of guilty and pay a flue in the amount of Five Dollars ($5.00) to the Clerk of the Municipal Court within ten (10) days. In the event the party charged desires to enter a plea of not guilty he may obtain a trial setting from the Clerk of the Municipal Court. Such cases shall be heard by the Municipal Court Judge in accordance with the laws, rules and /or ordinances governing criminal cases." SECTION 2. Any person, firm or corporation violating the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction, shall be fined in a sum not to exceed Two Hundred ($200) Dollars. SECTION 3. All ordinances or parts of ordinances in conflict herewith shall be and are hereby repealed to the extent of conflict herewith.
