HomeMy WebLinkAbout11053 ORD - 08/23/19728RR:� • 8/23/72:1st , AN ORDINANCE AMENDING THE ZONING ORDINANCE, ORDINANCE 6106, AS AMENDED, BY AMENDING ARTICLE 33, PERMITS, PLATS, AND FILING FEES, SECTION 33 -2, PLATS, TO HEREAFTER READ AS HEREINAFTER PROVIDED; REPEALING ALL ORDI- NANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, there have been forwarded to the City Council reports and recommendations concerning certain amendments to the text of the Zoning Ordi- nance of the City of Corpus Christi, Texas; and WHEREAS, by motion duly made, seconded and carried, it was decided by the City Council that to approve the hereinafter set forth amendments would best serve the public health, necessity and convenience and the general wel- fare of the City and its citizens: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, passed on the 27th day of August, 1937, appearing of record in Volume 9, pages 565 et seq of the Ordinance and Resolution Records, as amended from time to time, and in particular as amended by Ordinance No. 6106, passed and approved by the City Council on the 29th day of March, 1961, be, and the same is hereby, amended by making the changes hereinafter set out. SECTION 2. That section 33-2 Plats., of Article 33, Permits, Plats, and Filing Fees, be amended to thereafter read as follows: "Section 33 -2 Plats. All applications for building permits shall be accompanied by a drawing or plat in duplicate or as required by the Depart- ment of Engineering Services, showing with dimensions the lot lines, the building or buildings, the locations of buildings on the lot, signs and /or billboards, and such other information as may be necessary to provide for the enforcement of these regulations, including if necessary the boundary survey and a staking of the lot by a competent surveyor, provided, however, that in any such application for a building permit for the purpose of erecting a bill- board sign only on unplatted and vacant land by any applicant not the owner of the land, and said applicant owns therein nothing more than a leasehold interest or lesser estate in the land, or if said applicant is the owner of the land which is vacant and upon which there are no improvements, then and in that 111053 • JRR.vmp • 8/23/72:lst event a showing of an approved and filed plat shall not be a condition prece- dent for the granting of such a permit and such plat shall not be required. However, the billboard or billboards shall be removed and the property platted prior to the issuance of a permit for a use other than a billboard or bill- boards. The drawing shall contain suitable notations indicating the proposed use of all land and buildings. A careful record of the original copy of such applications and plats shall be kept in the offices of the Department of Engineering Services and a duplicate copy shall be kept in the building at all times during construction." SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 5. Publication shall be made one time in the official pub- lication of the City of Corpus Christi, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 6. That the necessity of immediately making the aforesaid change for the purpose of maintaining at all times a comprehensive zoning ordinance for the City of Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emer- gency and necessity exist, having requested the suspension of such Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage -2- t CORPUS CHRISTI TEXAS DAY OF �9 7 TO THE MEMBERS OF THE CITY COUNCIL --F-= CORPUS CHRISTI TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY •CLAUSE OF THE FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL 13E PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND.PASS THIS ORDI- NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL. - RESPECTFU LYE O mow J THE CITY OF CORPUS CHRISTI, TEXAS THE CHARTER RULE WAS SUSPENDED BY THE FOLLOWING VOTE: RONNIE SIZEMORE ' CHARLES A.
