HomeMy WebLinkAbout11062 ORD - 09/06/1972JRR:vm �- 9/1/72: let AN ORDINANCE APPROVING AND PROVIDING FOR THE EXECUTION OF A FIRST AMENDATORY OPEN -SPACE CONTRACT AMENDING CONTRACT NO. TEX. OSC- 85(DL) BY AND BETWEEN THE CITY OF CORPUS CHRISTI AND THE UNITED STATES OF AMERICA; AND DECLAR- ING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. The pending proposed First Amendatory Contract, Amending Open -Space Contract No. TEX. OSC- 85(DL), dated (as heretofore amended), by and between the City of Corpus Christi (herein called the "Public Body "), and the United States of America (herein called the "Government "), is hereby in all respects approved. SECTION 2. The City Manager is hereby authorized and directed to execute the Amendatory Contract in two counterparts on behalf of the Public Body, and the Secretary is hereby authorized and directed to impress and attest the official seal of the Public Body on each such counterpart and to forward such counterparts to the Department of Housing and Urban Development, for execution on behalf of the Government, together with such other documents relative to the approval and execution of such counterparts as may be required by the Government. SECTION 3. The necessity for approving and providing for the execu- tion of a First Amendatory Contract at the earliest possible date creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspen- sion of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the � _ day of September, 1972. �1 ATTEST i City Secre MAYOR THE CITY E CHRISTI, TEAS APPROVED: DAY F� , 1972: " 062 "City At ,r A�.9ey . ,,9i"U _� " UNITED STATES OF AMERICA DEPARTMEI ;T OF HOUSING AND URBAN DEVELOPMENT FIRST AMENDATORY CONTRACT AMENDING GRANT AGREEMENT - -NO. OSC- 85(DL) THIS First Amendatory Contract, made and entered into on the date herein below specified, by and between the City of Corpus Christi (herein called the "Applicant ") and the United States of America (herein called the "Government "), WITNESSETH: WHEREAS the Parties hereto entered into that certain 'Grani'7Cgreement No. Tex. OSC- 85(DL) dated the 28th day of July, 1470; called the "Existing ontract" (herein g ), and the Parties now desire to amend the Existing Contract: rOW, THEREFORE, -in consideration of the mutual covenants, promises, and representations contained herein and in the Existing Contract, the Parties hereto agree as follows: 1. The Existing Contract is hereby amended by exscinding from Section 4 of Part I thereof the amount $15,600.00 and insertieg in lieu thereof the amount $18,451.00. 2. Unless otherwise indicated, all provisions hereby authorized are effective on the date of this Amendatory Contract. IN WITNESS IRIEREOF, the Applicant has caused this Amendatory Contract to be duly executed in its behalf and its seal to be hereunto affixed and attested; and thereafter, the Government has caused the same to be duly executed in its behalf- on the day of CITY OF CORPUS CHRISTI (SEAL) By.
