TEAS: AN ORDINANCE AMENDING THE CORPUS CHRISTI CITY CODE, AS AMENDED, BY ADDING TO SECTION 21 -2, DEFINITIONS, OF CHAPTER 21, MOTOR VEHICLES AND TRAFFIC, THE DEFINITIONS OF COMMERCIAL VEHICLE AND LOADING ZONE; REPEALING THE PRESENT SECTION 21 -118 AND ADOPTING IN LIEU THEREOF A NEW SECTION AS IIEREINAPTER MORE FULLY SET FORTH; PROVIDING A SEVERANCE CLAUSE; REPEALING AIL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING FOR PUBLICATION. CBE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the Corpus Christi City Code, as amended, be and the same is hereby amended by adding to Chapter 21, MOTOR VEHICLES AND TRAFFIC, Section 21 -2, Definitions, the following: "Commercial vehicle: Any motor vehicle (other than a motor- cycle or passenger car) designed or used primarily for the transportation of property, including any passenger car which has been reconstructed so as to be used for delivery purposes or having the name of the firm inscribed or painted on the front door on both sides in letters at least two (2 ") inches high. "Loading zone: The space adjacent to a curb reserved for the exclusive use of commercial vehicles during the loading and unloading of materials." SECTION 2. That Section 21 -118 be and the same is hereby repealed in its entirety and in lieu thereof there is hereby adopted a new Section 21 -118 to hereafter read as foll(ws: "STANDING IN CURB LOADING ZONES: No person shall stop, stand or park any motor vehicle in any loading zone on any of the streets of the City except as provided below: a) Commercial vehicles loading, unloading, delivering or picking up freight or materials shall be permitted to park in loading zones for a period not to exceed thirty (30) minutes. b) Incases where due to the nature of the freight and materials or the business involved, loading operations will necessitate parking vehicles for a period longer than thirty (30) minutes, then the Traffic Engineer may issue, after evidence is presented to him of such need, special permits for such operation. 11073 c) Where construction vehicles involved in building, construc- tion, remodeling or maintenance must be parked in loading zones or on the City streets for extended periods of time, the City Traffic Engineer may issue permits for such privilege. A fee of $1.00 per day for each construction vehicle will be charged for the first ten (10) days, thereafter the charge diall be $10.00 per month. d) Noncommercial vehicles shall be permitted to park in load- ing zones on Sunday, holidays and during the hours when the provisions applicable to such zones are not in effect." SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 4. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed to the extent of conflict. SECTION 5. Publication shall be made one time in the official publication of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance.
