HomeMy WebLinkAbout11078 ORD - 09/13/1972JRR:jkh:9- 13 -72; 1st • AN ORDINANCE AMENDING THE AGREEMENT AUTHORIZED BY ORDINANCE NO. 10902 BETWEEN THE CITY OF CORPUS CHRISTI AND SARATOGA LAND COMPANY BY CHANGING THE LAST SENTENCE OF SECTION Ila OF SAID AGREEMENT AS HEREINAFTER MORE FULLY SET FORTH; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Agreement authorized by Ordinance No. 10902, passed and approved by the City Council on June 7, 1972, be and the same is hereby amended by amending Section IIa, the last sentence thereof, so as to hereafter read as follows: "Deeding of the City -owned drainage right -of -way to Saratoga Land Company will be done prior to the com- pletion of the reinforced concrete box by Saratoga Land Company and subject to Saratoga Land Company complying with all the provisions of the agreement and all platting regulations." SECTION 2. Except as herein amended, the terms and conditions of Ordinance No. 10902 shall be and remain in full force and effect. SECTION 3. The necessity to immediately amend the agreement between the City of Corpus Christi sad the Saratoga Land Company as herein - above set forth creates a public emergency and an imperative public neces- sity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and neces- sity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this ,,6 day of September, 1972. ATTEST: d O Citf Secretary MAYOR APPROVED: , 3 74 THE CI OF US CHRISTI, TEXAS A��oFney �, i 07 f. • THE STATE OF TEXAS X COUNTY OF NUECES X WHEREAS, on the day of June, 1972, by authority of Ordinance No. 10902, passed and approved by the City Council on June 7, 1972, the City of Corpus Christi entered into an agreement with the Saratoga Land Company pertaining to the Company's obligations in con- structing a drainage ditch and paving said area and the City's obliga- tions relating to drainage, street and bridge improvements in the development of Country Club Estate Subdivision, south of Saratoga Boulevard, in the City of Corpus Christi, Nueces County, Texas; and WHEREAS, it is mutually agreed by and between the City of Corpus Christi and the Saratoga Land Company to amend Section IIa of the aforesaid agreement by substituting the following sentence in lieu of the present last sentence of said Section IIa: "Deeding of the City -owned drainage right -of -way to Saratoga Land Company will be done prior to the com- pletion of the reinforced concrete box by Saratoga Land Company and subject to Saratoga Land Company complying with all the provisions of the agreement and all platting regulations." Except as herein amended, the terms and condithns of the agreement heretofore entered into by and between the City of Corpus Christi and Saratoga Land Company shall be and remain in full force and effect.
