HomeMy WebLinkAbout11098 ORD - 09/27/1972• JRR:jkh:9- 22 -72; let AN ORDINANCE CLOSING A PORTION OF THE CUL -DE -SAC LOCATED AT THE INTERSECTION OF BAYLARK DRIVE AND SEALANE DRIVE IN THE SOUTH BAY ADDITION TO THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing con- cerning the closing of a portion of the cul-de -sac located at the inter- section of Baylark Drive and Sealane Drive in the South Bay Additioh to the City of Corpus Christi, Nueces County, Texas, was given by publication and registered mail to the last known addresses of the owners of property abutting said portion of cul -de -sac and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Meeting of the City Council of the City of Corpus Christi on Wednesday, September 20, 1972, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close that portion of the cul-de -sac hereinafter more fully described for use as a public street: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a portion of the cul -de -sac located at the intersection of Baylark Drive and Sealane Drive in the South Bay Addition to the City of Corpus Christi, Nueces County, Texas, more fully described hereinafter, be and is hereby closed for public use as a public street and abandoned to the owners of the abutting property: Being a portion of the right -of -way of Baylark Drive proposed to be abandoned, shown by map of South Bay Addition Unit 01 as filed for record in Volume 32, Page 56 of the map records of Nueces County, Texas; Beginning at a point in the southwest right -of -way line of Baylark Drive, the common corner of Lots 2 and 3, Block 1, thence with said right -of -way line N. 61° 08' W. 56.85' to the point of curve of a circular curve to the left same corner being the most southerly corner and POINT OF BEGINNING of this tract; Thence continuing with said curve whose central angle 46° 34', radius - 30 feet, tangent - 12.91 feet, for an arc distance of 24.38 feet to a point of reverse curve of a circular curve to the right; and Thence with said curve whose central angle - 106° 34' 02 ", radius - 50 feet, tangent = 67.04 feet, for an are distance of 93 feet to a point in the southeasterly boundary line of Lot 5 for the most northerly corner of this tract; Thence along the line of projection of said southwesterly right -of -way of Baylark Drive S. 61° 08' E. 101.39 feet to the point of beginning. Being a portion of the right -of -way of Sealane Drive proposed for abandonment and shown by map of South Bay Addition Unit O1 filed for record in Volume 32, Page 56 of the map records of Nueces County, Texas: Beginning at the east corner of Lot 50 the south corner of Lot 6, Block 1 for a corner in the northwest boundary line of this tract and the point of beginning; Thence with a portion of the southeast boundary line of Lot 6, a circular curve to the left whose radius center bears N. 14° 26' W. 30 feet and whose tangent - 12.91 feet, for an are distance of 24.38 feet to the point of tangency and the most northerly corner of this tract; Thence with the projection of the northwest right -of -way line of Sealane Drive S. 29° W. 23.11 feet to the point of curve of a circular curve to the right; Thence with said curve whose central angle - 89° 52' tangent = 10 feet, radius - 9.98 feet, for an arc distance of 15.68 feet to the point of tangency and the most southerly corner of this tract; Thence N. 61° 08' W. 8.34 feet to a point in the south- easterly boundary line of Lot 5 for the most westerly cor- ner of this tract; Thence in an easterly direction with a circular curve to the right whose radius center bears S. 31° 03' 15" E. 50 feet and whose tangent - 7.30 feet; for an are distance of 14.50 feet to the point of beginning. SECTION 2. The fact that the public convenience and necessity would be better served by the closing of the hereinabove described portion of cul-de -sac at the intersection of Baylark Drive and Sealane Drive creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and -2- that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the-?- -):1-9 day of 41-- , 1972.
