AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE REAL ESTATE
SALES CONTRACT FOR THE ACQUISITION OF PARCEL 2,
MAYFIELD, STARLITE LANE DRAINAGE DITCH FROM THE ESTATE
OF J. M. DELLINGER; APPROPRIATING OUT OF NO. 296 STORM
SEWER BOND FUND $17,527.50, OF WHICH $17,331 IS FOR
LAND PURCHASE AND DAMAGES TO THE REMAINDER AND $196.50
IS FOR INCIDENTAL EXPENSES RELATED TO THE CLOSING OF
THE PURCHASE, ALL APPLICABLE TO PROJECT NO. 296 -70 -1,
MAYFIELD- STARLITE LANE STORM SEWER PROJECT; AND
DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That the City Manager be, and he is hereby,
authorized to execute real estate sales contract for the acquisition
from the J. M. Dellinger Estate of Parcel No. 2, Mayfield- Starlite
Lane Drainage Ditch, said tract or parcel being more particularly
described as follows:
Being a 10.832 acre tract of land out of the A. M. French
237.2 acres out of Survey No. 417, Abstract 571 as described
in deed recorded in Volume 165, page 265, Deed Records,
Nueces County, Texas, said 10.832 acre tract of land being
more particularly described by metes and bounds as follows:
Beginning at a point in the east boundary line of Westwood
Heights, a subdivision, as shown by map of record in
Volume 23, page 42, Map Records, Nueces County, Texas,
said point being N. 0° 11' 20" E., 216.41 feet from the
Southeast corner of such subdivision, said point also
being in the west boundary line of said Survey 417, for
the most northerly northwest corner of the tract herein
described;
Thence S. 89° 53' 40" E., with the north boundary line
of a 30 foot wide Drainage Easement conveyed to Nueces
County by Right -of -Way Easement recorded in Volume 749,
page 250, Deed Records, Nueces County, Texas, a distance
of 118.34 feet to a point for the most northerly northeast
corner of the tract herein described;
Thence S. 0° 16' 40" W., at 30.0 feet pass tte south line of
said 30 foot wide drainage easement, in all a distance of
631.37 feet to a point, the point of curve of a circular
curve to the left;
Thence in a Southeasterly direction with the arc of said
curve to the left whose central angle is 75° 27' 10 ", and
whose radius is 116.96 feet, an arc distance of 154.02 feet
to a point, the P. T. of said curve;
Thence S. 75° 10' 30" E., a distance of 1358.62 feet to a
point for an interior corner of the tract herein described;

Thence S. 89° 43' 20" E., a distance of 985.01 feet
to a point in the west right -of -way line of 70 foot wide
McKinzie Road, for the most easterly northeast corner of
the tract herein described;
Thence S. 11° 29' E., with the west right -of -way line of said
McKinzie Road, a distance of 157.30 feet to a point for the
Southeast corner of the tract herein described;
Thence N. 89° 43' 20" W., a distance of 1036.73 feet to a
point for a corner of this tract;
Thence N. 75° 10' 30" W., a distance of 1331.74 feet to a
point, the point of curve of a circular curve to the right
for a corner of this tract;
Thence in a northwesterly and northerly direction with the
are of said curve to the right whose central angle is 75°
27' 10 ", and whose radius is 283.03 feet, an arc distance
of 372.72 feet to a point in the east line of Lot 85,
Artemus Roberts Subdivision as shown by Map of record in
Volume 3, page 40, Map Records, Nueces County, Texas, for
a corner of the tract herein described;
Thence N. 0° 16' 40" E., with the east line of said Lot 85,
and with the east right -of -way line of an existing 20 foot
road, at 412.38 feet pass the northeast corner of said Lot
85, in all a distance of 414.10 feet to an angle point for a
corner of the tract herein described;
Thence N. 0° 11' 20" E., at 0.5 feet pass the Southeast
corner of Westwood Heights Subdivision as shown by Map of
record in Volume 23, page 42, Map Records, Nueces County,
Texas, and continuing with the same call, a total distance
of 216.91 feet to the point of beginning.
Containing 10.832 acres of land more or less, herein
sometimes called "subject property ".
SECTION 2. There is hereby appropriated out of No. 296 Storm
Sewer Bond Fund the sum of $17,527.50, of which $17,331 is for land purchase
and damages to the remainder and $196.50 is for incidental expenses related
to closing of the purchase, all applicable to Project No. 296 -70 -1,
Mayfield - Starlite Lane Storm Sewer Project.
SECTION 3. The necessity to immediately execute the aforesaid
real estate sales contract and to appropriate the necessary sums in order
to purchase the hereinabove described parcel or tract of land in order that
the Mayfield- Starlite Lane Storm Sewer Project may continue without delay
creates a public emergency and an imperative public necessity requiring
the suspension of the Charter rule that no ordinance or resolution shall
be passed finally on the date of its introduction but that such ordinance

or resolution shall be read at three several meetings of the City Council,
and the Mayor having declared such emergency and necessity to* exist, and
having requested the suspension of the Charter rule and that this ordinance
be passed finally on the date of its introduction and take effect and be
in full force and effect from and after its passage, IT IS ACCORDINGLY SO
