FOR THE CON- STRUCTION OF THE LEOPARD STREET 48" WATER TRANSMISSION MAIN, SAID CHANGE ORDER REPRESENTING ADDITIONAL COST IN- CURRED BY THE CONTRACTOR FOR THE USE OF DUCTILE PIPE AND FITTINGS IN LIEU OF STEEL PIPE AND FITTINGS ACROSS THE FAULT ZONE AREA; APPROPRIATING OUT OF THE NO. 202 WATER SYSTEM BOND FUND $28,184.25 FOR THE AFORESAID CHANGE ORDER OF WHICH $12,223.15 IS FOR THE CONSTRUCTION CONTRACT AND $15,961.10 IS FOR CONTINGENCIES AND INCIDENTAL EXPENSES, INCLUDING $15,931.10 FOR RESIDENT INSPECTION AND $30.00 FOR LABORATORY TESTING; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be, and he is hereby authorized • to execute Change Order No. 8 to the contract with Burtex Constructors, Inc. for the construction of the Leopard Street 48" water transmission main, Project No. 202 -68 -29.1, said Change Order representing additional cost incurred by the contractor for the use of ductile pipe and fittings in lieu of steel pipe and fittings across the fault zone area, a copy of said Change Order No. 8 being attached hereto as Exhibit "A ", and made a part hereof. SECTION 2. There is hereby appropriated out of the No. 202 Water System Bond Fund $28,184.25 for the aforesaid Change Order No. 8, of which $12,223.15 is for the construction contract and $15,961.10 is for contingencies and incidental expenses, including $15,931.10 for resident inspection and $30 for laboratory testing. SECTION 3. The necessity to authorize the execution of the aforesaid Change Order and the appropriation of the necessary funds in order that the project may continue without delay creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the ,.J_ -U- day of October, 1972.
