A RESOLUTION
AUTHORIZING THE CITY MANAGER TO SUBMIT AN AMENDED
APPLICATION FOR A FEDERAL GRANT UNDER THE FEDERAL
WATER POLLUTION CONTROL ACT, PUBLIC LAW 660, AS
AMENDED, TO ASSIST THE CITY IN THE CONSTRUCTION OF
A 500 GPD SEWAGE TREATMENT PLANT WITH TERTIARY
TREATMENT, FOUR LIFT STATIONS, FORCE MAINS, AND
GRAVITY TRUNK MAINS ON PADRE ISLAND AND A LIFT
STATION, FORCE MAIN, AND GRAVITY TRUNK MAIN IN THE
CLARKWOOD AREA; DESIGNATING THE CITY MANAGER, R. MARVIN
TOWNSEND, AS THE AUTHORIZED REPRESENTATIVE WITH AUTHORITY
TO SIGN DOCUMENTS NECESSARY TO COMPLETE THE PROJECT; AND
DECLARING AN EMERGENCY.

WHEREAS, it is contemplated that the City of Corpus Christi,
Texas will construct certain wastewater treatment facilities; and it is
deemed necessary and proper to apply for a federal grant under the Federal
Water Pollution Control Act, Public Law 660, as amended:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, - TEYAS:
SECTION 1. That R. Marvin Townsend, City Manager, or his successor,
is hereby authorized and directed to submit an amended application for a
Federal Grant under the Federal.Water Pollution Control Act, Public Law 660,
as amended, and to sign the Acceptance of the Offer, when made, and any
other necessary documents required to complete the project on behalf of

the above named Applicant.
SECTION 2. That the above named Applicant will perform the following:

A. Acquire a fee simple or such other estate or interest in the
i site of the project, including the necessary easements and rights -of -way,
as to assure undisturbed use and possession; and that in the event such
title, estate, or interest in such site, easements or rights -of -way may
i in the future be contested, the above named Applicant will defend and
maintain its title in such site and hold the United States Government

blameless is such action; and that before any federal payment is requested
4 pursuant to a grant, the above named Applicant will provide certification
r as to the sufficiency of such estate or interest.

B. Provide an operation and maintenance manual for the facilities
which is acceptable to the State Water Pollution Control Agency and the
Federal Water Quality Administration and will fulfill the tasks described
therein.

C. Provide the necessary funds which are estimated to be approxi-
mately $19.4nn Per annum for the proper operation and maintenance of
the facilities.
D. Employ qualified personnel in accordance with the recommends-
tions or requirements of the State Water Pollution Control Agency to operate
the wastewater treatment facilities; and will require its consulting engineer
or agent to provide certain on- the -job training for employees during start -up
of the facilities.
SECTION 3. The necessity to file the said amended application
as soon as possible to obtain available Federal funding creates a public
emergency and an imperative public necessity requiring the suspension of
the Charter rule that no ordinance or resolution shall be passed finally
on the date of its introduction but that such ordinance or resolution
shall be read at three several meetings of the City Council, and the Mayor
having declared such emergency and necessity to exist, and having requested
the suspension of the Charter rule and that this resolution be passed
finally on the date of its introduction and take effect and be in full force
and effect from and after its passage, IT IS ACCORDINGLY SO RESOLVED, this

FOR THE REASONS SET FORTH IN THE EMERGENCY .CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
