HomeMy WebLinkAbout11147 ORD - 11/01/1972JRR:jkh:11-1 -72; let AN ORDINANCE CLOSING THE ALLEY LOCATED BETWEEN LOT 1, BLOCK 2, TEMPLE ADDITION; LOT 1, BLOCK 2, CROCKETT HEIGHTS; LOT 1, BLOCK 1, SAN DIEGO ADDITION; LOT 1, BLOCK 8, CASA BLANCA ADDITION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; RESERVING THE NECESSARY EASE- MENTS FOR EXISTING UTILITIES; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a bearing con- cerning the closing of an alley between Lot 1, Block 2, Temple Addition; Lot 1, Block 2, Crockett Heights; Lot 1, Block 1, San Diego Addition; and Lot 1, Block 8, Casa Blanca Addition, in the City of Corpus Christi, Nuecea County, Texas, was given by publication and registered mail to the last known addresses of the owners of property abutting said alley and within 450 feet o` the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Meeting of.the City Council of the City of Corpus Christi on Wednesday, October 11, 19720 in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that it would best serve the public convenience and necessity to close said alley as that portion of the alley is not now needed for alley pur- poses (but will be needed for utility purposes), nor will it, within the foreseeable future be needed as a public alley; and WHEREAS, it has been determined that it is to the advantage of the City to close the above described portion of said alley so that the same may be used by the abutting property owners for other purposes; however, the City Council has determined that it is necessary to retain the entire 25 -,foot alley as a utility easement: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the alley located between Lot 1, Block 2, Temple Addition; Lot 1, Block 2, Crocket Heights; Lot 1, Block 1, San Diego Addition; and Lot 1, Block 8, Casa Blanca Addition, situated in the City of Corpus Christi, Nuecea County, Texas, hereinafter more fully described, be and the same is hereby closed for public use and abandoned to the owners of abutting property, subject to the retention by the City of the entire 25 -foot alley for utility easement, and this closure is 111147 conditioned on such - reservation being effected and preserved: and Being a 25.0 foot by 95.02 foot strip of land lying southwest of and adjacent to Lot 1, Block 8, Casa Blanca, a subdivision of the City of Corpus Christi, as shown by map of record in Volume 9, page 10, Map Records, Nueces County, Texas, Being a 25.0 foot by 95.98 foot strip of land lying southwest of and adjacent to Lot 1, Block 1, San Diego Addition, as shown by map of record in Volume 9, page 26, Map Records, Nueces County, Texas. The 25.0 feet by 95.98 feet is abandoned to the owner of Lot 1, Block 1, San Diego Addition; the 12.5 feet by 95.02 feet abutting Lot 1, Block 8, Casa Blanca Addition, is abandoned to the owner of said Lot 1, Block 8, Casa Blanca Addition; and the 12.5 feet by 95.02 feet abutting Lot 1, Block 2, Crockett Heights, is abandoned to the owner of said Lot 1, Block 2, Crockett Heights. In the_ event any reservation of easement herein made by this closing is nullified, invalidated or revoked by any legal authority or by final judgment of a court of competent jurisdiction, this closure is thereby voided to the extent of such revocation or invalidation of easement. SECTION 2. The fact that the public convenience and necessity would be better served by the closing of the aforesaid alley creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the of November, 1972. 6 City SecietarV MAYOR THE CITY OF C S CHRISTI, TEXAS APPRO •Y t NOVEMBER, 1972: C/i y Attorney y, }(, oI 4LW .
