HomeMy WebLinkAbout11165 ORD - 11/08/1972JRR:jkh:11-7 -72; 1st TEXAS: AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE AGREEMENTS WITH THE OWNERS OF LOTS 3, 4, AND 5, SECTION 4, FLOUR BLUFF & ENCINAL FARM AND GARDEN TRACTS, WHEREBY THE OWNERS WILL DEDICATE 10 -FOOT AND 60 -FOOT DRAINAGE EASEMENTS AND REIMBURSE THE CITY IN THE SUM OF $5,000 FOR CONSTRUCTION OF REINFORCED CONCRETE PIPE AND BOX STORM SEWERS IN CONNECTION WITH THE GARDENDALE AREA STORM SEWER IMPROVEMENTS, AS MORE FULLY SET FORTH IN THE AGREEMENT, A COPY OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT 'W', AND MADE A PART HEREOF; NO DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, SECTION 1. That the City Manager be, and he is hereby, authorized to enter into an agreement with the owners of Lots 3, 4, and 5,-Section 4, Flour Bluff & Encinal Farm and Garden Tracts, whereby the owners will dedicate 10 -foot and 60 -foot drainage easements and reimburse the City in the sum of $5,000 for construction of reinforced concrete pipe and box storm sewers in connection with the Gardendale Area Storm Sewer Improvement project, as more fully set forth in the agreement, a copy of which is attached hereto, marked Exhibit 'W', and made a part hereof. SECTION 2. The necessity to enter into the aforesaid agreement at the earliest practicable date in order that the aforesaid storm sewer improvement project may be continued without delay creates a public emer- gency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 9-U, day of November, 1972. JRR:jkh:11- 7- 72;1at • AGREEMENT THE STATE OF TEXAS X COUNTY OF NUECES X This agreement entered into between the City of Corpus Christi, a municipal corporation and body politic, operating under the home rule statutes of the State of Texas, hereinafter called "City ", and F. W. Heldenfels, Jr., Individually and as Executor of the Estate of F. W. Heldenfels, Sr., Alice Cullen Heldenfels, and Rae Orms Heldenfels; H. C. Heldenfels, J. R. Heldenfels; Nark P. Bratton; and Coastal Development, Inc., hereinafter called "Owners ", WITNESSETH: WHEREAS, the City of Corpus Christi desires to construct drainage improvements in the Gardendale Area; and WHEREAS, said drainage improvements will require the crossing of Owners' lands; and WHEREAS, such crossing will require a 60 -foot wide and a 10 -foot wide drainage easement across Owners' land; and [AREAS, Owners desire to develop said land in accordance with the provisions of the Platting Ordinance; and WHEREAS, in contemplation of such development, the elimination of large open drainage ditches is desired by City and Owners: NOW, THEREFORE, City and Owners agree as follows: 1. City will issue a Change Order to the contract for storm sewer improvements presently under construction by H b H Construction Company to effectuate the following: A. Construct a reinforced concrete pipe within the 10 -foot wide drainage easement, a copy of which is attached hereto, marked Exhibits "A" and "B ". Such pipe shall be of such design and capacity as to handle the designated area and to permit Owners to tie into said pipe when their land is developed. B. Construct a reinforced concrete box within the 60 -foot wide drainage easement as shown on the attached Exhibits "C" and "D", sized to handle the drainage area designated for Gardendale and to permit Owners to tie into said pipe when their land is developed. W" xN�a� C. Permit Owners to construct a street over the reinforced concrete box and within the 60 -foot right -of -way for drainage at the time the land is developed. D. Leave all excavated material'on the site upon completion of the project. 2. Owners agree as follows: A. Dedicate to City the 10 -foot and 60 -foot wide drainage easements across their lands as indicated on the attached exhibits. B. Pay to City upon completion and acceptance of the Gardendale Area Storm Sewer Improvement Project the sum of Five Thousand Dollars ($5,000) as betterment to the land resulting from City's improvements. 3. This agreement shall be executed in quadruplicate, each of which shall be considered an original. When the parties hereto have executed the same, this agreement shall become effective and inure to the benefit of the parties hereto and their respective heirs, successors and assigns.
