Bonniwell Roberto Bosquez, M.D. Rev. Harold T. Branch Commissioners Thomas V. Gonzales Gabe Lozano, Sr. J. Howard Stark T. Ray Kring Secretary with the following absent: Mayor Ronnie Sizemore and Commissioner Gabe Lozano, Sr. constituting a quorum, at which time the following among other business was transacted: Mr. Bonniwell, Mayor Pro Tem, presented for the consideration of the Council an ordinance. The ordinance was read by the City Secretary. The Mayor Pro Tem presented to the Council a communication in writing pertaining to said proposed ordinance,.as follows: "Corpus Christi, Texas November 15, 1972 "TO THE CITY COUNCIL Corpus Christi, Texas Gentlemen: The public importance and pressing need for the perma nent improvements to be constructed by use of the proceeds of bonds contemplated to be voted pursuant to an ordinance create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring ordinances to be'considered and voted upon at three regular meetings. I, I therefore, request that the City Council pass the proposed ordinance calling an election for the issuance of said bonds as an emergency measure. You will please consider this request in connection with the ordinance which is to be introduced for passage by the City Council on this subject. i Yours very truly, /s/ Charles A. Bonniwell Mayor Pro Tem" X1'71 • Commissioner Stark moved that the Charter provi- sion prohibiting ordinances from being passed finally on the date introduced be suspended for the reasons stated in the written request of the Mayor Pro-Tem and stated in the emergency clause of the ordinance. The motion was seconded by Commissioner Bosquez. The motion was carried by a unanimous vote by the City Council, viz: AYES: Commissioners Bonniwell, Bosquez, Branch, Gonzales, and Stark. NAYS: None. Commissioner Branch moved that the ordinance be finally passed. The motion was seconded by Commissioner Gonzales, The motion was carried by the following vote: AYES: Commissioners Bonniwell, Bosquez, Branch, Gonzales, and Stark. NAYS: None. The Mayor Pro -Tern announced that the ordinance had bee:. passed. The ordinance is as follows: ORDINANCE NO. U / -71 BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, CALLING AN ELECTION ON THE QUESTION OF THE ISSUANCE OF IMPROVE- MENT BONDS. WHEREAS, the City Council of said City deems it advisable to issue the bonds of said City for the purposes hereinafter stated; and WHEREAS, it is hereby officially found and determined: that a case of emergency or urgent public necessity exists which requires the holding of the meeting at which this Ordinance is passed, such emergency or urgent public necessity being that the proceeds from the proposed bonds are required as soon as possible and without delay for necessary and urgently needed public improvements; BE IT ORDAINED BY THE CITY.COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: 1. That at said election the following PROPOSITIONS shall be submitted in accordance with law: UPPER LEVEL COLLEGE $1,500,000 PROPOSITION NO. 1 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $1,500,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of the ACQUISITION OF BUILDINGS AND FACILITIES FOR AN UPPER LEVEL COLLEGE; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? CONVENTION FACILITIES $11,000,000 PROPOSITION 140. 2 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $11,000,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of waking permanent public improvements, to -wit: A MULTI - PURPOSE EXHIBIT, MEETING, BANQUET, AND CONVENTION FACILITY AND THE ACQUISITION AND DEVELOPMENT OF THE SITE THEREFOR INCLUDING BUT NOT LIMITED TO PARKING AND LANDSCAPED AREAS, SUCH SITE TO BE BOUNDED BY THE BAYFRONT SCIENCE PARK, THE BAY, AND A LINE FROM SHORELINE DRIVE ALONG HUGHES, NORTH WATER, FITZGERALD, AND NORTH MESQUITE STREETS BACK TO THE BAYFRONT SCIENCE PARR; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? . • AUDITORIUM $4;900,000 • PROPOSITION NO. 3 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $4,900,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of making permanent public improve- ments, to -wit: A MULTI - PURPOSE AUDITORIUM; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? SANITARY SEWER $3,600,000 PROPOSITION NO. 4 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $3,600,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such-rates as shall be determined within the discretion of the City Council, for the purpose of CONSTRUCTING IMPROVEMENTS TO THE SANITARY SEWER SYSTEM, INCLUDING BROADWAY PLANT IMPROVE- MENT, SARATOGA MAIN, CALALLEN TRUNK, AND LINES IN THE FLOUR BLUFF, CALALLEN, TULOSA MID- WAY, AND CORPUS CHRISTI BEACH AREAS AND OTHER SANI- TARY SEWER IMPROVEMENTS; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount suffi- cient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PARKS $3,525,000 PROPOSITION NO. 5 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $3,525,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of IMPROVING LANDS FOR PARK PURPOSES INCLUDING SOUTH (McGEE) AND CORPUS CHRISTI BEACH DEVELOPMENT, SOFTBALL FIELD FACILITIES, SWIMMING POOLS AT FLOUR BLUFF AND WOODLAWN PARKS, MUSEUM IMPROVEMENTS, AND IMPROVEMENTS AT BAYFRONT, LOS ENCINOS, WOODLAWN, COLE AND VARIOUS OTHER PARKS; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes.in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? I TRANSPORTATION $850,000 PROPOSITION NO. 6A Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $600,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of ENLARGING THE SITE AND PROVIDING FACILITIES FOR THE CITY'S INTERNATIONAL AIRPORT; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION NO.6B Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $250,000, with the bonds of each such series or issue,.respectively, to mature serially _ within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of BUYING BUSES TO OPERATE THE CITY'S PUBLIC BUS TRANSPORTATION 'STEM; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PUBLIC BUILDINGS $1,900,000 PROPOSITION N0. 7p, 01i, I.- the City Council of said City be authorized to issue the bonds if said City, in one or more series or issues, in the aggregate principal amount of $300;000, with the bonds of each such series or issue, respectively, to mature serially with- in not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discre- tion of the City Council, for the purpose of permanent public improvements, to -wit: FIRE DEPARTMENT AND POLICE BUILDINGS; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount suffi- cient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? • PROPOSITION N0. 7B • Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $1,300,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined.within the discretion of the City Council, for the purpose of making permanent improvements, to -wit: HEALTH FACILITY BUILDINGS (EXCLUDING MEDICAL AND HOSPITAL CARE FACILITIES); and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION..NO. 7C Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $300,000, with the bonds of each such aeries or issue, respectively, to mature serially within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of making permanent IMPROVEMENTS TO THE MUNICIPAL SERVICE CENTER; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? DRAINAGE $3,200,000 PROPOSITION NO. 8 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $3,200,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the dis- cretion of the City Council, for the purpose of CONSTRUCTING DRAINAGE IMPROVEMENTS, INCLUDING BAY - FRONT PUMP STATION MODIFICATION, DITCH IMPROVEMENTS ALONG FLYNN AND SHEA PARKWAYS, AND THE VAN GALEN DITCH; LOCAL DRAINAGE IN THE SIR POINTS, MAYFIELD LANE, CASA BLANCA, ARBOLEDA, FLOUR BLUFF, AND LORRAINE STREET AREAS, MAJOR DRAINAGE FACILITIES IN THE WEST OSO HIGH SCHOOL AND WILLIAMS DRIVE AREAS, AND OTHER DRAINAGE FACILITIES; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount suffi- cient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? i� i� STREETS $4,275,000 PROPOSITION NO. 9 i Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $4,275,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed twenty -five years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of IMPROV- ING THE STREETS OF THE CITY, INCLUDING NEIGHBORHOOD STREETS, SIDEWALKS TO SCHOOL SITES, TRAFFIC SIGNALS, STREET LIGHTING, LEOPARD STREET RESURFACING FROM BATTLIN BUC TO BROADWAY, AIRLINE FROM PADRE ISLAND DRIVE TO WILLIAMS DRIVE, KOSTORYZ FROM PADRE ISLAND DRIVE TO HOLLY ROAD, McARDLE ROAD FROM AIRLINE TO MT. VERNON PARK, NORTH STAPLES FROM LEOPARD TO BROADWAY, NUECES BAY BOULEVARD FROM LEOPARD TO IH 37, WALDRON FROM CARRIBEAN.TO PURDUE, STAR.LITE FROM LEOPARD TO SUNNY, COOPER ALLEY FROM MESQUITE TO TANCAHUA AND OTHER STREET IMPROVEMENTS; and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? 3. That said election shall be held and conducted !i in effect as two separate but simultaneous elections, to -wit: one election at which only the resident, qualified ielectors who own taxable property in the City and who have duly rendered the same for taxation shall be entitled to vote on l said PROPOSITIONS, and another election at which all other iresident, qualified electors of the City shall be entitled to vote on said PROPOSITIONS. The votes cast at each of said ',separate but simultaneous elections shall be recorded, returned, jand canvassed separately. It is hereby declared that the purpose of holding the election in such manner is to ascertain arithmeti- cally: (a) the aggregate votes cast at the election for and I ;against said PROPOSITIONS by resident, qualified electors of the (City, and also (b) the aggregate votes cast at the election for 'land against said PROPOSITIONS by resident, qualified electors li !who own taxable property in the City and who have duly rendered ,the same for taxation. Each elector shall be entitled to vote ionce, in accordance with the foregoing provisions of this :iOrdinance. �I 4. That voting machines shall be employed at the election herein ordered in accordance with the provisions of V.A.T.S. Election Code, Article 7.14. 6. That the City Secretary of the City of Corpus Christi shall be the clerk for absentee voting at said election; and the office of said City Secretary in the City Hall is hereby designated as the place at which absentee voting shall be con- ducted for said election, during the regular office hours of said City Secretary. Voting machines shall be used both for absentee voting by personal appearance and for voting at the regular polling places at said election; but paper ballots shall be used for absentee voting by.mail. A Special Canvassing Board shall be appointed by the Mayor, as provided by law, to count and canvass all absentee votes and ballots cast at said election. 7. A substantial copy of this Ordinance shall serve as proper notice of said election. Notice shall be given in accordance with Article 704, Revised Civil Statutes of 1925, i as amended. The Mayor is authorized and-directed to have a copy of said notice posted at the City Hall in said City and at each of the voting places in said City, not less than fifteen i I days prior to the date fixed for holding said election. He shall also cause said notice to be published on the same day in each of two successive weeks in a newspaper of general circulation published within said City, the date of the first- publication to be not less than fourteen days prior to the date set for said election. Except as otherwise provided in said Article 704, as amended, the manner of holding said election shall be governed by the laws governing general elections. 8. That the public importance and the pressing need for the permanent improvements to be constructed by use of the proceeds of the sale of said bonds create an emergency and an imperative public necessity requiring the suspension of rules and Charter provisions requiring same to be considered and voted upon at three regular meetings, and such facts require that this ordinance be passed and take effect immediately as an emergency measure, and such rules and provisions are hereby suspended and this ordinance is passed and shall take effect as an emergency measure, and shall be in full force and effect immediately upon its passage. 9. It is hereby officially found and determined that the meeting at which said election was called was open to the public as required by law and public notice of the time, place, and purpose of said meeting was given as required by Vernon's Ann. Civ. St., Article 6252 -17, as amended.
