HomeMy WebLinkAbout11180 RES - 11/22/197211 /22 /72:HGse • 1st A RESOLUTION PROVIDING FOR FULL UNLIMITED ACCESS AND USE OF THE TOTAL IMPROVEMENTS TO THE PUBLIC OF THE BEACH PRESERVED AND RESTORED BY THE CORPUS CHRISTI BEACH RESTORATION PROJECT, AS MORE FULLY DESCRIBED HEREIN; PROVIDING FOR MAINTAINING SAID BEACH AS A PUBLIC BEACH; AND DECLARING AN EMERGENCY. WHEREAS, the City of Corpus Christi, Texas, and the United States Army Corps of Engineers have proposed the preser- vation and restoration of Corpus Christi Beach as a public beach; and WHEREAS, said restoration is to be financed by City Bond Funds with matching Federal funds expended; and WHEREAS, the letter dated February 9, 1970, from Lt. General William F. Cassidy, Chairman, Board of Engineers for Rivers and Harbors, Washington, D. C., found in House Document No. 91 -415, dated November 16, 1970, 91st Congress, 2d Session, which recommends the restoration of Corpus Christi Beach, requires as a condition precedent, at 14.e.,that the City: and "e. Provide without cost to the United States access and facilities necessary for realization of the public benefits upon which Federal partici- pation is based and maintain continued.public ownership of the beach and administer it for public use during the life of the project; "; WHEREAS, the Report of the District Engineer found in the aforementioned House Document No. 91 -415, provides in para- graph 9. that the City assure the continued ownership and administration of the beach for public use; and WHEREAS, the aforementioned Report provides for local cooperation at paragraph 46. and said cooperation requires the City at subparagraph e. to: "e. Provide, without cost to the United States, an adequate width of beach in public ownership fronting the private development with acceptable access and facilities necessary for realization of the public benefits upon which Federal participation is based, and maintain continued public ownership of the beach and its administration for public use during the economic life of the project; "; ili.8® U and • WHEREAS, based on the foregoing, the City Council and the Army Corps of Engineers require that said Beach Restoration Project is to be a public beach and all citizens are to have full, unlimited access and use of the total improvements of said Project: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That in the Corpus Christi Beach Restoration Project as contemplated and described in the survey report on Corpus Christi Beach, Texas, dated May 16, 1969, Serial No. 153, by the United States Army Corps of Engineers, and as printed in House Document No. 91 -415, 91st Congress, 2d Session, the public shall at all times have full, unlimited access and use of the total improvements described in said survey report for the public and all citizens. The City of Corpus Christi will at all times maintain said project as a public beach with free and open access to all citizens during the economic life of said project. SECTION 2. The necessity to insure that the aforementioned Corpus Christi Beach Restoration Project be and remain open to the general public with full, unlimited access and use of the total improvements to the public, creates a public emergency and imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that.such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and neces- sity to exist, and having requested the suspension of the Charter rule and that this Resolution be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the .2Z_ day of November, 19 ATTEST• IO City Secre a MAYOR THE CIT OF US CHRISTI, TEXAS APPROVED: 22ND DAY OF N.
