HomeMy WebLinkAbout11186 ORD - 11/29/1972JRR:RWC:ml:11- 3- 72;lst • AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF CECIL ADDKINSON BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON THE NORTHERLY 3.248 ACRES OF TRACT B, LOT 5. LOKEY SUBDIVISION, SITUATED IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, FROM "F -R" FARM RURAL DISTRICT TO "I -2" LIGHT INDUSTRIAL DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS 'CONCERNING THE APPLICATION OF Cecil Addkinson FOR AMENDMENT TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO APPEAR AND BE HEARD WERE HEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON October 18, 1979 , AT q,2p, {„1 COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE ND. 6106, AS AMENDED, BE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. all ia; 0 .. MOTION moved and seconded the motion that Ordinance authorizing lease agreement with the Oso Little Misses Kickball of a 4.23 -acre tract of land in South Guth Park, read on the first two of three readings, be amended, prior to final passage, as follows: Add a new Paragraph 9 to the lease agreement, reading as follows: "9. Lessee further agrees to use the Southwest portion of said tract for parking purposes as indicated on the attached map, marked Exhibit 2, incorporated herein by reference and made a part hereof. Lessee shall be responsible for construction and maintenance of a parking area, and suitable entrance and exit roads on said portion of the tract in accordance wi.vh standards set out bythe Director of Parks and Recreation. Lessee may also use for parking purposes the Southeast portion of the Oso Fa =ional Pony League Tract as 13iicated on the attached map." Renuaber the present Paragraph 9 .a Paragraph 10 of the agreement. Motion carried. THAT TIIC ZONING OF the Northerly 3.248 acres of Tract B, Lot 5, Lokey Subdivision, situated in the City of Corpus Christi, Nueces County, Texas, more particularly described hereinafter, be and the same is hereby changed from "F -R" Farm -Rural District to "I -2" Light Industrial District: BEING the Northerly 3.248 acres of Tract B, Lot 5, Lokey Subdivision as shown by map thereof recorded in Volume 7, pages 16 and 17, Map Records of Nueces County, Texas, being more particularly described by metes and bounds as follows: BEGINNING at a 5/8 inch iron rod, the Northeast corner of Lot 6, Tract 5 -13, Lokey Subdivision shown by map of same recorded in Volume 34, page 65 of the Map Records of said county for the Southeast corner and point of beginning of this tract; THENCE with the Northeast boundary line of said Lot 6, North 61° 00' 40" West, 140 feet to a 5/8 inch iron rod for the North- west corner of said Lot 6 and the Southwest corner of this tract; THENCE with the Easterly right -of -way line of a 50 foot wide easement for street known as Lokey Street, North 29', East 1010.50 feet to a 3/4 inch iron pipe set for the Northwest corner of this tract whence the Northwest corner of said Tract B, Lot 5 bears North 61° 00' 40" West, 25 feet to the centerline of said Lokey Street and along the projection of said centerline North 29 °, East 30 feet; THENCE South 610 00' 40" East, 140 feet to a 3/4 inch iron pipe set in the Easterly boundary line of said Tract B for the Northeast corner of this tract; THENCE with said boundary line, South 290, West 1010.50 feet to the POINT OF BEGINNING, SECTION 3. THAT THE OFFICIAL ZONING NAP OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION II. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF - CORPU,9 CHRISTI, TEXAS, APPROVED ON THE 277H DAY OF AUGUST, 1937, AS AMENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE AND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- rLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND -2- ..16 AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION'SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED PINALLY ON TH2 DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY 50 ORDAINED, THIS THEc;n—d— DAY or November, 1972 ATTEST: .o a.
