BY TTIE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS, CANVASSING
RETURNS AND DECLARING RESULTS OF AN
ELECTION ON T11E QUESTION OF TILE
ISSUANCE OF IMPROVEMENT BONDS; AND
DECLARING AN EMERGENCY.
WHEREAS, heretofore on the 15th day of November,
1972, the City Council of the City of Corpus Christi, Texas,
passed an ordinance calling an election•to be held in said
City on the 9th day of December, 1972, on the Propositions
hereinafter stated; and
WHEREAS, said City Council has investigated all
matters pertaining to said election, including the ordering,
giving notice, officers, holding, and making returns of said
election; and
WHEREAS, the election officers who held said election
have duly made the returns of the result thereof, and said
returns have been duly delivered to said City Council; ani
WHEREAS, it is hereby officially found and determined:
that a case of emergency or urgent public necessity exista which
requires the holding of the meeting at which this Ordinance is
passed, such emergency or urgent public necessity being that the
proceeds from the proposed bonds are required as soon as possible
and without delay for necessary and urgently needed public
improvements; that said meeting was open to the public as
required by law; and that public notice of the time, place,
and purpose of said meeting was given, all as required by
Vernon's Ann. Civ. St. Article 6252 -17, as amended.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
1. That the City Council officially finds and
determines that said-election was duly ordered, that proper
notice of said election was duly given, that proper election
officers were duly appointed by the City Council prior to said
election, that said election was duly held, that due returns of
the result- of said election have been made and delivered, and
that the City Council has duly canvassed said returns, all in
accordance with law.
2. That the City Council officially finds and
determines that the following votes were cast at the election
on each submitted Proposition, by the resident, qualified
electors who own taxable property in said City, and who have
duly rendered the same for taxation, and who voted at the
election:

4. That the City Council officially finds,
determines and declares the result of said election to be
that all said Propositions so submitted, with the exception
I of Proposition No. 2, received a favorable vote by the
ii
majority of all resident, qualified electors who own
taxable property in said city and who had duly rendered the
same for taxation voting at said election and all proposi-
tions, including Proposition No. 2, received a favorable
majority vote by all other qualified electors voting at
such election.
5. That the public importance and pressing need
for the permanent improvements to be constructed by use
of the proceeds of the sale of said bonds create an emer-
gency and an imperative public necessity requiring the suspen-
sion of rules and Charter provisions requiring same to be
considered and voted upon at three regular meetings, and
such facts require that this ordinance be passed and take
effect v miediately as an emergency measure, and such rule.;
and pro•n.sions are hereby suspended and this ordinance is
passed and shall take effect as an emergency measure, and
shall be in full force and effect immediately upon its passage.
6. It is hereby officially found- and determined that
the meeting at which said election returns were canvassed was
open to the public as required by law and publid notice of
the time, place, and purpose of said meeting was given as
required by Vernon's Ann. Civ. St. Article 6252 -17, as

amended.

FOR THE REASONS SET FORTH IN THE EMERGENCY .CLAUSE OF THE FOREGOING
ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN-
SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL
BE PASSED FINALLY ON THE DATE IT IS INTRODUCED AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; Is THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCEDS OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.

Council of the City of Corpus Christi, Texas, convened in
Regular Meeting, with the following members of said Council
present, to -wit:

constituting a quorum, at which time'the following among other
business was transacted:
Mr. Sizemore, Mayor, presented for the consideration
of the Council an ordinance. They ordinance was read by fie City
Secretary. The Mayor presented r_o the Council a communicat ion
in writing pertaining to said proposed ordinance, as follows:

"TO THE CITY COUNCIL
Corpus Christi, Texas
Gentlemen:
The public importance and pressing need for the perman-
ent improvements to be constructed by use of the proceeds of
bonds voted at an election held December 9, 1972, create
an emergency and an imperative public necessity requiring the
suspension of rules and Charter provisions requiring ordinances
to be considered and voted upon at three regular meetings. I,
`therefore, request that the City Council pass the proposed ordi-
nance canvassing election returns for the issuance of said bonds
as an emergency measure. You will please consider this request
in connection with the ordina h is'to be introduced for
passage by the City Counci on this ubject.

Commissioner moved that the Charter
provision prohibiting ordinances from being passed finally on
the date'introduced be suspended for the reasons stated in the
written request of the Mayor and stated in the emergency clause
of the ordinance. The motion was seconded by Commissioner

the City Council, viz:
AYES: Commissioners Bonniwell, Bosquez, Branch,
Gonzales, Lozano and Stark.
NAYS: None.
The Mayor requested that the records show that he
voted Aye. This was done.

passed finally. The motion was seconded by Commissioner
