HomeMy WebLinkAbout11202 ORD - 12/13/1972• JRR:jkh:12- 12 -72; ;.at • AN ORDINANCE CLOSING AND ABANDONING TO ORTHMED BUILDING CORPORATION THE EASEMENTS ALONG THE SOUTH LINE OF LOT 1 AND THE 14EST LINE OF LOT 1 AND THE WEST LINE OF LOT 3, UNIT I, WASHBURN MEADOWS ADDITION; PROVIDING THAT ALTERNATE EASEMENTS BE DEDICATED; PROVIDING THAT THE ABANDONMENT BE SUBJECT TO THE RELOCATION OF ALL UTILITY LINES LOCATED IN THE PORTIONS TO BE ABANDONED AT THE APPLICANT'S EXPENSE; PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. WHEREAS, there exist easements along the south line of Lot 1 and the west line of Lot 1 and the west line of Lot 3, Unit I, Washburn Meadows Addition, which easements were dedicated to the City of Corpus Christi by the Orthmed Building Corporation; and WHEREAS, it has been determined that it is feasible and advantageous to the City to abandon the easements hereinabove described to the owner of said parcels ox tracts of land, subject to the dedication of alternate easements by said owner, and the relocation cf all utility lines located in that portioi of the existing easements wh::ch are to be abandoned: NOW, THEREFORE, BE IT ORDAINED BY :HE CITY COUNCIL OF THE CITY OF CORPUS CHRI:'TI, TEXAS: SECTION 1. That the existing easements granted to the City by Orthmed Building Corporation along the south line of Lot 1 and the west line of Lot 1 and the west line of Lot 3, Unit I, Washburn Meadows Addition, be and the same are hereby abandoned to the owner of the property, Orthmed Building Corporation, subject to the dedication by said Orthmed Building Corporation of alternate easements to the City of Corpus Christi. This abandonment will become effective upon completion of the relocation, at the expense of the said corporation, of all utility lines presently located in that portion of the easements to be abandoned by the City, said utility lines to be relocated and dedicated when the property is repoctted. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, id -W2 clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the aforesaid easements creates a public emergency and an imperative public necessity requiring the suspen- sion of the Charter rulethat no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the 3_ k day of December, 2.
