HomeMy WebLinkAbout11224 ORD - 12/27/1972JRR; jkh:12- 26 -72; J.at ,� • AN ORDINANCE CLOSING ALL OF THAT PORTION OF A 40 -FOOT STREET LOCATED BETWEEN LOTS 1 AND 11, AND 2 AND 10, IN LYLE SUBDIVISION, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, TO BE EFFECTIVE UPON DELIVERY TO THE CITY OF A DEDICATION DEED DEDICAT- ING THE EAST 20 FEET OF LOTS 1 AND 11 FOR THE WIDENING OF GREENWOOD DRIVE 20 FEET, IN ACCORDANCE WITH TEE MASTER PLAN FOR GREENWOOD DRIVE; REVOKING ORDINhXCE NO. 88741 DATED MAY 220 1968; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing concerning the closing of all except the east 40 feet of that portion of a street located between Lots 1 and 11, and 2 and 10, in Lyle Subdivision, in the City of Corpus Christi, Nueces County, Texas, was given by publica- tion and registered mail to the last known addresses of the owners of property abutting said portion of the street proposed to be closed and within A50 ;eet of the area to be closed, end thereafter, pursuant to said notice, public hearing was held at Re „ular'Council Meeting by the City Couacil of the City of Corpus Christi on February 7, 1968, in accordance .r'th the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the portion of the street proposed to be closed is not needed now, nor will it be within the foreseeable future needed as a public street; and WHEREAS, it has been determined that it is to the advantage of the City to abandon the portion of the street aforesaid, as a public street so that the same may be used by the abutting property owners for other purposes; and WHEREAS, the City Council on May 22, 1968, passed Ordinance No. 8874 closing the east 20 feet of said right of way and agreeing to close the west 20 feet after the abutting owners dedicated 20 feet of additional right of way for Greenwood Drive improvements and relocated an existing eight -inch effluent line; and WHEREAS, the conditions specified in Ordinance No. 8874 have not been met: X224 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Ordinance No. 8874 be and the same is hereby revoked in its entirety. SECTION 2. That all of the east 40 feet of that portion of a street located between Lots 1 and 11, and 2 and 10, in Lyle Subdivision, in the City of Corpus Christi, Nueces County, Texas, is hereby closed for public use and abandoned to the owners of the abutting property, to be effective upon delivery to the City of a Dedication Deed dedicating the east 20 feet of Lots 1 and 11 forthe widening of Greenwood Drive, in accordance with the Master Plan for Greenwood Drive. SECTION 3. The City will relocate the eight -inch (8 ") effluent line in such right of way within 180 days after the dedication of the Greenwood Drive right of way. SEC -ION 4.
