Iii Authorizing and directing the City Manager to execute, for and on behalf of the City of Corpus Christi, a Supplemental Agreement with the State of Texas, for and on behalf of the Texas Highway Department, covering the Roadway Illumination System on S.H. 358 from the east end of the Airline Road Interchange to the east end of the Ayers Street Interchange for the purpose of illuminating signs in connection with the illumination of the roadway, copy of which Supplemental Agreement, identified as Project "E" is attached hereto and made a part hereof; and declaring an emergency. WHEREAS,-an expressway illumination agreement has been entered into between the State of Texas and the City of Corpus Christi covering the Construction, Maintenance and Operation of a Roadway Illumination System on S.H. 358 from the east end of the Airline Road Interchange to the east end of the Ayers Street Interchange, and in the aforesaid agreement the City of Corpus Christi and the State have agreed to each pay a portion of the cost of the electrical energy for the roadway illumination system; and WHEREAS, the Texas Highway Department proposes to install overhead guide signs complete with illumination for this section rf S.H. 358, and since it would be more economical to utilize the transformer stations designed to supply power to the expressway illumination circuits rather than install separate power sources for the overhead guide sign illumination; and WHEREAS, the State of Texas and the City of Corpus Christi have agreed to formalize their understanding by written agreement, and it is necessary that the City Manager execute such agreement; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS; SECTION 1. That the City Manager be, and he is hereby, authorized and directed to execute, for and on behalf of the City of Corpus Christi, a Supplemental Agreement with the State of Texas, for and on behalf of the Texas Highway Department, covering the roadway illumination system on S.H. 358 from the east end of the Airline Road Interchange to the east end of the Ayers Street Interchange for the purpose of illuminating signs in connection with the illumination of the roadways, copy of which Supplemental Agreement is attached hereto and made a part hereof; Supplemental Agreement Project "E" adds 24 each 1 -lamp F72T12 fluorescent and 68 each 2 -lamp F72T12 fluorseent sign units to the roadway illumination agreement. i SECTION 2. The necessity to authorize the hereinabove described Supplemental Agreement at the earliest practicable date creates a public emergency and an imperative public necessity requiring the suspension of the Charter Rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter Rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the �QQ day of 1973. All cost of construction of the overhead guide signs and sign illumination system as provided by the signing project plans and specifications, such as sign luminaires, conduits, and electrical conductor will be financed by the State. 2. The State hereby agrees to reimburse the City in the amount of 1007 of the cost of electrical energy used by that portion of the overhead sign illumina- tion system connected to the roadway illumination system transformer stations. The quantity of electrical energy used by the overhead sign illumination system shall be determined by multiplying the sum of the manufacturer's rated input wattages, as shown on the project plans of that portion of the overhead sign illumination system connected to the roadway illumination system transformer stations, by the number of hours the lamps are energized divided by 1000. The number of hours that the lamps are energized shall be from dusk until dawn each night in the year, the total burning time for each lamp being approximately thirty -nine hundred and fifty (3,950) hours during each year. 3. The State's payment for the electrical energy cost for that portion of the overhead sign illumination system connected to the roadway illumination system transformer stations shall be based upon the minimum unit rates charged the City under the City's contract with the power agency supplying electrical energy to the City. The City will forward the State two copies of its existing contract with the power agency for electrical energy, and thereafter will furnish two copies of subsequent contracts as the existing or governing control is terminated and new contracts are executed. 4. The State further agrees to maintain the overhead guide signs and the overhead guide sig: illumination system including the circuits from the overhead sign mounts to the roadway illumination system transformer stations where connections' are made for power, and any circuits and service poles installed byrhe State specifi- cally for the purpose of furnishing electrical energy to the overhead guide signs. 5. This agreement shall remain in force for a period of two years from the date of execution, and it shall be understood by both parties that at the end of this two year period and each succeeding two year period the agreement will be automatically renewed for two years unless terminated in writing by either party 30 days prior to the termination date.
