CLOSING CARTER STREET, FROM NAPLES TO THE EAST
PROPERTY LINE OF LOT 10, BLOCK 3, SOUTHMORF.LAND
ADDITION, IN THE CITY OF CORPUS CHRISTI, NUECES
COUNTY, TEXAS, FOR PUBLIC USE'AS A PUBLIC STREET
" AND ABANDONED TO THE OWRERS OF THE ABUTTING PROPERTY,
SUBJECT TO RETENTION BY THE CITY OF THE PRESENT WIDTH
OF THE STREET AS A.UTILITY EASEMENT; PROVIDING FOR
REPEAL OF ORDINANCE NO. 11,230, PASSED AND APPROVED
BY THE CITY COUNCIL ON DECEMBER 27, 1972; PROVIDING
FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a hearing
concerning the closing of Carter Street from Naples Street to the east
property line of Lot 10, Block 3, Southmoreland Addition, in the City of
Corpus Christi, Nueces County, Texas, was given by publication and
registered mail to the last known addresses of the owners of property
abutting said street and within 450 feet of the area to be closed and
thereafter, pursuant to said notice, public hearing was held at Regular
Meeting of the City Council of the'City of Corpus Christi, on Wednesday,
December 13, 1972, in accordance with the provisions of the City Charter;
and
WHEREAS, it was determined by the City Council after such hearing
that it would best serve the public convenience and necessity to close
the street within the limits hereinabove set forth for use as a public
street, subject to retention by the City of the present width of the
street as a utility easement; and
WHEREAS, by Ordinance No. 11,230, the City Council declared
its intent to close Carter Street, from Naples Street to the east
property line of Lot 10, Block 3, Southmoreland Addition; and
WHEREAS, the said Ordinance No. 11,230 contained an incorrect
and incomplete description of the portion of Carter Street to be closed,
and it is the desire of the City Council to correct the description at
this time:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the portion of Carter Street, from Naples to
the East property line of Lot 10, Block 3, Southmoreland Addition, in the
City of Corpus Christi, Nueces County, Texas, be and the same is hereby

closed for public use as a public street and abandoned to the owner of
the abutting property, subject to retention, however, by the City of the
present width of the street as a utility easement.
SECTION 2. That Ordinance No. 11,230 be and the same is hereby
repealed in its entirety.
SECTION 3. If for any reason any section, paragraph, subdivi-
sion, clause, phrase, word, or provision of this ordinance shall be held
invalid or unconstitutional by final judgment of a court of competent
jurisdiction it shall not affect any other section, paragraph, subdivision,
clause, phrase, word, or provision of this ordinance, for it is the
definite intent of this City Council that every section, paragraph,
subdivision, clause, phrase, word, or provision hereof be given full force
and effect.
SECTION 4. The necessity to inmediately close the aforesaid
street for use as a public street and abandon the same to the owners of
abutting property so that the same may be used for other purposes creates
a public emergency and an imperative public necessity requiring the sus-
pension of the Charter rule that no ordinance or resolution shall be
passed finally on the date of its introduction and that such ordinance
or resolution shall be read at three several meetings of the City-Council,
and the Mayor having declared such emergency and necessity to exist, and
having requested the suspension of the Charter rule and that'this ordinance
be passed finally on the date of its introduction and take effect and be
in full force and effect from and after its passage, IT IS ACCORDINGLY SO
ORDAINED, this thesy of January, 1973.

CITY COUNCIL. .
