HomeMy WebLinkAbout11274 ORD - 01/24/1973*F JRR:LWH:1- -10 -73;, lst, AN ORDINANCE AN ORDINANCE ADOPTING STANDARDS FOR SIGNS ERECTED WITHIN THE CITY OF CORPUS CHRISTI AND WITHIN 660 FEET OF THE NEAREST EDGE OF THE RIGHT -OF -WAY OF IH 37, US 77, US 181, SH 286, SH 358, AND THAT PORTION OF SH 44 WEST OF SH 358; MAKING EXCEPTIONS FOR OFFICIAL AND ON- PREMISE SIGNS: RE- QUIRING LICENSES FOR NEW SIGNS AND EXISTING SIGNS; ESTABLISHING PERMIT FEES; MAKING VIOLATIONS A MISDEMEANOR PUNISHABLE BY FINE NOT EXCEEDING $200; PROVIDING FOR PUBLICATION; AND PRO- VIDING A SAVINGS CLAUSE. •SECTION 1. TITLE. This ordinance shall be know as the Highway Beautification Ordinance. SECTION 2. SCOPE. This ordinance shall apply to signs located within the City of Corpus Christi, Texas, and within 660 feet of the nearest Edge of the right -of -way of interstate and federal -aid primary highway systems, being those highways cesignated as IH 37, US 77, US 181, SH 286, SFI 358, and that portion of SF 44 west of SH 358. SECTION 3. DEFINITIONS. a. "Sign," shall mean an outdoor sign, light, display, device, figure, painting, drawing, m essage, placard, Poster, billboard, or other thing which is designated, intended, or used to•advertise or inform. b. "Official Signs" shall mean directional and other official signs authorized by law, including signs pertaining to natural wonders and scenic and historic attractions, and signs which have as their purpose the protection of life and property. c. "On- premise signs" shall mean signs advertising the sale or lease of the property on which they are located, and signs advertising activities conducted on the premises upon which they are located. d. "Traveled Way" means that portion of the roadway used for the movement.of vehicles, exclusive of shoulders and auxiliary lanes. e. "Main Traveled Way" means the through traffic lanes exclusive of frontage roads, auxiliary lanes, and ramps. 11274 JRR:LWH:2nd dr. 1 -17-73 • f. "Erect" means to construct, buila, raise, assemble, place, affix, attach, create, paint, draw or in any other tray bring into being or establish except when performed incidental to tine change of an advertising message or to noraktl maintenance or repair of an existing sign. g. "freeway" means a divided highway with full control of access. SECT10P1 4. STANDARDS. a. Signs shall not imitate or resemble any official traffic sign, signal, or device. b. Signs shall not be' erected or maintained upon trees or painted or. drawn upon rocks or other natural features. C. No sign shall exceed 1,200 square feet in area. d. No sign shall exceed 25 feet in height., e•. No sign shall exceed 60 feet in length, f. All dimensions include border and trim, but exclude supports. g. Double faced, back -to -back; or V type signs shall be considered as one sign. h. Signs which exceed 350 square Feet in area may not be double faced (staked or side -by- side). i. Signs may not be located in such a manner as to obscure or other- wise interfe -e with the effectiveness of an official traffic sJgn, signal, or device, or to obstruct or interfere with the driver's view of approaching, merging, or intersecting traffic. j. Signs may not be located within 500 feet 'of any public park., public forest, public playground, or scenic area so designated by a governmental Agency, which is adjacent to the highway. k. Signs may not be erected closer than 100 feet apart on the same side of the highway. 1.*Adjacent to freeways, signs may not be erected closer than 500 feet apart on the same side of tine freeway. m. Signs may be located closer than the spacing requirements established herein, provided that such signs are separated by buildings, natural surroundings, or other obstructions so that only one sign located within the specified spacing is visible at any one time. Signs which contain, include, or are illuminated by any flashing, intermittent, or moving light or lights are prohibited, except those giving public service information such as ti,, date, t rp- -rature, weather or similar information. o. Lights which are not effectively shielded as to prevent beams or rays of light from being directed at any portion of the traveled ways of the highways, and which are of such intensity or brilliance as to cause glare or to ims it the vision of the driver of any motor vehicle, or which otherwise interfere with any driver's operation of•a motor vehicle, are prohibited. P. No sign shall be so illuminated that it interferes with the effectiveness of or obscures an official traffic sign, device, or signal. SECTION 5. APPLICABILITY. Signs shall not be located outside of the "B -5 ", "B -61', "I -2 ", and "I -3" zoning districts of the city. Every sign erected within the City of Corpus Christi, Texas, and within 660 feet of the nearest edge of the right- of-way of IH 37, US 77, US 181, SH 286, SH 358, and that portion of SH 44 west of SH 358 shall omply with the standards established by this ordinance, with the following exceptions: a. Official signs. b. Chi- premise signs. c. Signs which are not visible from any point on the main traveled way viewed from a height of not more than six (6) feet above any such point. sEGTICN 6. all-ER omnzANcEs. Every sign regulated by this ordi- nance shall also comely with the zoning ordinance, building code,, and all other applicable codes and ordinances of the City of Corpus Christi, Texas. SECTION 7. LICENSES, PERMITS, AND FEES. The Building official shall issue building permits for signs regulated by this ordinance only to persons who hold valid licenses issued by the Texas Highway CmTd.ssion pursuant to the provisions of the Texas Highway Beautification Act. The minimum fee for said building permits shall be ten dollars. SE(TIM 8. EXISTING SIGNS. Every owner of every existing sign which lies within the City of Corpus Christi, Texas, and within 660 feet 43) JRR -17 r..d dr. 1 -17 -73 of the nearest edge of the right -of -way of IH 37, US 77, US 181, SH 286, SH 358, and that portion of Sh 44 west of SH 358, with the exception of official signs and on- premise signs, shall apply for and obtain a license issued by the Texas Highway Commission pursuant to the provisions of the Texas Highway Beautification Act, authorizing the maintenance of said sign after December 31, 1972. SECIION 9. VIOLATION. Any person who shall violate any provision of this ordinance shall be deemed guilty of a misdemeanor and punished by a fine not exceeding two hundred dollars. If the violation be con- tinuing, then each day's violation shall constitute a separate offense. Each item of violation shall constitute a separate offense. SECTION 10. This ordinance shall take effect from-and after its publication one time in the official publication of-the City of Corpus Christi, which publication shall contain the caption stating in summary the purpose of the ordinance and the penalty for violation thereof. SECTION 11. If for any reason any section, paragraph, subdivision, clause, phrase, or provision of this ordinance shall be held invalid, it shall not affect any valid provisions of this or any other ordinance of the City of Corpus Christi to which rules and regulations relate.
