AN ORDINANCE
AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE
A SUPPLEMENTAL AGREEMENT WITH THE STATE OF TEXAS
COVERING THE ROADWAY ILLUMINATION SYSTEM ON U.S. 181
FROM SOUTH END OF CORPUS CHRISTI SHIP CHANNEL BRIDGE
TO WACO STREET; U.S. 181 FROM NUECES BAY CAUSEWAY
TO SOUTH END OF CORPUS CHRISTI SHIP CHANNEL BRIDGE;
LOOP 14143 FROM SHORELINE BOULEVARD WEST TO U.S. 181
AND S.H. 286 FROM I.H. 37 TO SOUTH OF GOLLIHAR ROAD,
FOR THE PURPOSE OF ILLUMINATING SIGNS IN CONNECTION
WITH THE ILLUMINATION OF THE ROADWAY, COPY OF WHICH
SUPPLEMENTAL AGREEMENT, IDENTIFIED AS PROJECT "F" IS
ATTACHED HERETO, MARKED EXHIBIT "A" AND MADE A PART
HEREOF; AND DECLARING AN EMERGENCY.
WHEREAS, AN EXPRESSWAY ILLUMINATION AGREEMENT HAS BEEN ENTERED INTO
BETWEEN THE STATE OF TEXAS AND THE CITY OF CORPUS CHRISTI COVERING THE CON-
STRUCTION, MAINTENANCE AND OPERATION OF A ROADWAY ILLUMINATION SYSTEM ON U.S.
181 FROM SOUTH END OF CORPUS CHRISTI SHIP CHANNEL BRIDGE TO WACO STREET; U.S.
181 FROM NUECES BAY CAUSEWAY TO SOUTH END OF CORPUS CHRISTI SHIP CHANNEL
BRIDGE; LOOP 14143 FROM SHORELINE BOULEVARD WEST TO U.S. 181 AND S.H. 286
FROM I.H. 37 TO SOUTH OF GOLLIHAR ROAD, AND IN THE AFORESAID AGREEMENT THE
CITY OF CORPUS CHRISTI AND THE STATE HAVE AGREED TO EACH PAY A PORTION OF THE
COST OF THE ELECTRICAL ENERGY FOR THE ROADWAY ILLUMINATION SYSTEM; AND
WHEREAS, THE TEXAS HIGHWAY DEPARTMENT PROPOSES TO INSTALL OVERHEAD
GUIDE SIGNS COMPLETE WITH ILLUMINATION FOR THESE SECTIONS OF U.S. 181, LOOP
14143 AND S.H. 286, AND SINCE IT WOULD BE MORE ECONOMICAL TO UTILIZE THE TRANS-
FORMER STATIONS DESIGNED TO SUPPLY POWER TO THE EXPRESSWAY ILLUMINATION CIRCUITS
RATHER THAN INSTALL SEPARATE POWER SOURCES FOR THE OVERHEAD GUIDESIGN ILLUMINA-
TION; AND
WHEREAS, THE STATE OF TEXAS AND THE CITY OF CORPUS CHRISTI HAVE
AGREED TO FORMALIZE THEIR UNDERSTANDING BY WRITTEN AGREEMENT:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. THAT THE CITY MANAGER BE, AND HE IS HEREBY, AUTHORIZED
AND DIRECTED TO EXECUTE, FOR AND ON BEHALF OF THE CITY OF CORPUS CHRISTI, A
SUPPLEMENTAL AGREEMENT WITH THE STATE OF TEXAS, FOR AND ON BEHALF OF THE TEXAS
HIGHWAY DEPARTMENT',' COVERING THE ROADWAY ILLUMINATION SYSTEM ON THESE SECTIONS
OF U.S. 181, LOOP 1443 AND S.H. 286 FOR THE PURPOSE OF ILLUMINATING SIGNS IN

CONNECTION WITH THE ILLUMINATION OF THE ROADWAYS, COPY OF WHICH SUPPLEMENTAL
AGREEMENT IS ATTACHED HERETO AND MADE A PART HEREOF; SUPPLEMENTAL AGREEMENT
PROJECT "Fn ADDS THREE (3) EACH ONE (1) LAMP F72T12 FLUORESCENT SIGN UNITS
AND ONE HUNDRED FIVE (105) EACH TWO (2) LAMP F72T12 FLUORESCENT SIGN UNITS
TO THE ROADWAY ILLUMINATION AGREEMENT AND REMOVES EIGHTEEN (18) EACH TWO (2)
LAMP F48T12 FLUORESCENT SIGN UNITS FROM THE SYSTEM.
SECTION 2. THE NECESSITY TO AUTHORIZE THE HEREINABOVE DESCRIBED
SUPPLEMENTAL AGREEMENT AT THE EARLIEST PRACTICABLE DATE CREATES A PUBLIC
EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE
CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE
DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ
AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED
SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION
OF THE CHARTER RULE AND THAT THIS ORDINANCE BE PASSED FINALLY ON THE DATE OF
ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND
AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THE DAY OF

SUPPLEMENTAL AGREEMENT
WHEREAS, an expressway illumination agreement has been entered into
between the State of Texas and the City of Corpus Christi covering the Construction,
Maintenance and Operation of an illumination system on U.S. 181 from south end of
Corpus Christi Ship Channel Bridge to Waco Street; U.S. 181 from Nueces Bay Cause-
way to South end of Corpus Christi Ship Channel Bridge; Loop 443 from Shoreline
Boulevard west to U.S. 181 and S.H. 286 from I.H. 37 to south of Gollihar Road and
in the aforesaid agreement the City of Corpus Christi and the State have agreed to
each pay a portion of the cost of the electrical energy for the roadway illumination
system, and
WHEREAS, the Texas Highway Department proposes to install overhead guide
signs complete with illumination for thes(: sections of U.S. 181, Loop 443 and S.H. 286,
and since it would be more economical to utilize the transformer station3 designed to
supply power to the expressway illumination circuits rather than instal.k separate
power sources for the overhead guide sign illumination;
NOW, THEREFORE, it is hereby agreed between the parties hereto that the
aforesaid agreements be modified to the extent as follows;
1. All cost of construction of the overhead guide signs and sign
illumination system as provided by the signing project plans and specifications, such
as sign luminaires, conduits and electrical conductor will be financed by the State.
2. The State hereby agrees to reimburse the City in the amount of 1009,
of the cost of electrical energy used by that portion of the overhead sign illumination
System connected to the roadway illumination system transformer stations. The quantity
Of electrical energy used by the overhead sign illumination system shall be determined

liy multiplying the sum of the manufacturer'a rated input wattages, as shown on the
project plans of that portion of the overhead sign illumination system connected to
the roadway illumination system transformer stations, by the number of hours the lamps
are energized divided by 1000. The number of hours that the lamps are energized Shall
be from dusk until dawn each night.in the year, the total burning time for each lamp
being approximately thirty -nine hundred and fifty (3,950) hours during each year.
3. The State's payment for the electrical energy cost for that portion of
the overhead sign illumination system connected to the roadway illumination system
transformer stations shall be based upon the minimum unit rates charged the City under
the City's contract with the power agency supplying electrical energy to the City. The
City will forward the State two copies of its existing contract with the power agency
for electrical energy, and thereafter will furnish two copies of subsequent contracts as the
existing or governing control is terminated and new contracts are executed.
4. The State further agrees to mrintain the overhead guide signs and the over-
head guide sign illumination system including the circuits from the overhead sign mounts
to the roadway illumination system transformer, stations where connections are made for .
power, and any circuits and service poles installed by the State speci£itally for the
purpose of furnishing electrical energy to the overhead guide signs.
5. This agreement shall remain in force for a period of two years from the
date of execution, and it shall be understood by both parties that at the end of this
two year period and each succeeding two year period the agreement will be automatically
renewed for two years unless terminated in writing by either party 30 days prior to the
termination date.

BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL'a I, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
