HomeMy WebLinkAbout11282 ORD - 01/24/1973JRR: RWC: e :1 /24/73 �.+I� 1st ; (�f� AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI ADOPTED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESO- LUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE 6106, AS AMENDED, UPON APPLICATION OF THE PLANNING COMMISSION BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON THE WEST 125' OF ST. PATRICK'S CHURCH TRACT, HEREINAFTER MORE FULLY DESCRIBED AND DESIGNATED AS "TRACT A ", FROM "R -2" TWO - FAMILY DWELLING DISTRICT TO "R -1B" ONE- FAMILY DWELLING DISTRICT, AND CHANGING.THE ZONING ON LOTS 33 THROUGH 54 AND 57 THROUGH 64, BLOCK 814, AND LOTS 33 THROUGH 54, BLOCK 815, PORT ARANSAS CLIFFS, HEREINAFTER DESIGNATED AS "TRACT B ", FROM "R -2" TWO- FAMILY DWELLING DISTRICT TO "AB" PROFESSIONAL OFFICE DISTRICT; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATION& CONCERNING THE APPLICATION OF THE CITY PLANNING COMMIS:ION FOR AMENWIENT TO THE ZONING MAP OF THE CITY OF COKPUS CHRISTI; AND WHEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL :LRSONS WISHING TO APPEAR AND BE HEARD WERE IfEARD, TO CONSIDER THE SAME BEFORE THE CITY COUNCIL OF THE CITY *OF CORPUS CHRISTI, IN ACCORDANCE WITH PROPER NOTICE TO THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD ON Wednesday, January 24, 1973 , AT Special COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL-IN THE CITY OF CORPUS CHRISSI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER-SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937, APPEARING OF RECORD IN VOLUME 9, PAGES 5U5, ET SEC, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE N0. 6106, AS AMENDED, HE AND THE SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. -11282 SECTION 2. That the zoning on TRACT A (the west 125' of St. Patrick's Church Tract) be changed from "R -2" Two- family Dwelling District to "R -1B" One - Family Dwelling District, said TRACT A being more fully described as follows: Being a portion out of the St. Patrick's Church Tract as recorded in Volume 19, page 36, Nueces County Map Records of Nueces County, Texas. BEGINNING at a 1" iron pipe in the southwest corner of the St. Patrick's Church Tract, such point also being at the northeast corner of the intersection of Alameda and Rossiter Streets; THENCE North 310 06 minutes west for a distance of 457.89' to a 1" iron pipe; THENCE North 450 00 minutes east for a distance of 130' to a point for corner; THENCE South 31° 06 minutes east for a distance of 500' to a point for corner; THENCE South 58° 54- minutes for a distance of 125' west to the place of beginning. Such area containing approximately 1.38 acres,more or less. That the zoning on TRACT B, being Lots 33 through 54 and 57 t.irough 64, Block 814, and Lots 33 through 54, Block 815, Port Aransas Cliffs, be changed from "R -2" Two- family Dwelling District to "AB" Professional Office District. Said above TRACT A and TRACT B being located in the 3300, 3400 and 3500 Blocks of South Alameda Street. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, BE, AND THE SAME IS HEREBY, AMENDED AS HEREIN ORDAINED. SECTION II. THAT THE ZONING ORDINANCE AND MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, APPROVED 014 THE 27TH DAY OF•AUGUST, 1937, AS AMENDED FROM TIME TO TIME, EXCEPT AS HEREIN CHANGED, SHALL REMAIN IN FULL FORCE IND EFFECT. SECTION 5. THAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HEREWITH ARE HEREBY EXPRESSLY REPEALED. SECTION 6. THAT THE NECESSITY OF IMMEDIATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE ZONING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER -2- o RULE THAT NO ORDINANCE OR RESOLUTION SHALL DE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREC SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EXISTS AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE DE PASSED FINALLY ON TI DATE OF ITS INTRODUCTION AND TAKE EFFECT AND DE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGES IT IS ACCORDINGLY SO ORDAINED, THIS THE ��DAY OF la f a 0 MAYOR THE CITY OF CO 5 CHRISTI, TEXAS r CORPUS CHRISTI TEXAS oZ ,.ODAY OF 1 19- TO THE MEMBERS OF THE CITY COUNCIL _ CORPUS CHRISTI, TEXAS FOR THE REASONS SET FORTH IN THE EMERGENCY •CLAUSE OF THE FOREGOING ORDINANCE, A PUBLIC EMERGENCY AND IMPERATIVE NECESSITY EXIST FOR THE SUSPEN- SION OF THE CHARTER RULE OR REQUIREMENT THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE IT 15 INTRODUCED AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; I, THEREFORE, REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORD, NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE CITY COUNCIL. - E CTFULLY� O MAYOR THE CITY.OF COR CHRISTI• TEXAS THE CHARTER RULE WAS-SUSPENDED BY THE FOLLOWING VOTE: " BONNIE SIZEMORE • - CHARLES A.
