HomeMy WebLinkAbout11294 ORD - 02/07/1973JRR:vmp:2/7 /73:1st AN ORDINANCE CLOSING AND ABANDONING THE 20 -FOOT STREET RIGHT OF WAY ALONG THE NORTHEAST SIDE OF LOTS 13, 14 AND 15, SECTION 42, AND A 40 -FOOT STREET RIGHT OF WAY BETWEEN LOTS 16, 17, AND 18, SECTION 42, AND LOTS 2, 3, 4, AND 5, SECTION 41, ALL IN FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, SUBJECT TO BEING REPLATTED, INCLUDING DRAINAGE EASEMENTS WHICH IN THE OPINION OF THE DIRECTOR OF ENGINEERING SERVICES ARE SUFFICIENT TO TAKE WATER FROM FLOUR BLUFF DRIVE TO THE OSO; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing con- cerning the closing of the 20 -foot street right of way along the northeast side of Lots 13, 14, and 15, Section 42, and a 40 -foot street right of way between Lots 16, 17, and 18, Section 42, and Lots 2, 3, 4, and 5, Section 41, all in Flour Bluff and Encinal Farm and Garden Tracts, in the City of Corpus Christi, Nueces County, Texas, was given by publication and registered mail to the last known addresses of the owners of property abutting said portions of street right of way proposed to be closed and within 450 feet of the area to be closed, and thereafter, pursuant to said notice, public hear- ing was held at Regular Council Meeting of September 6, 1972, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council after such hearing that the portions of street right of way proposed to be closed are not needed now, nor will they be, within the foreseeable future, needed as public streets; and WHEREAS, it has been determined that it is to the advantage of the City to close and abandon the portions of street right of way aforesaid, as public streets so that the same may be used by the abutting property owners for other purposes, said closing and abandoning to be subject to the replat- ting of the area involved, including drainage easements necessary to take water from Flour Bluff Drive to the Oso of such size and location to, in the opinion of the Director of Engineering Services, provide for the flows con- templated in the Master Drainage Plan: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the 20 -foot street right of way along the northeast side of Lots 13, 15, and 16, Section 42, and the 40 -foot street right of way between Lots 16, 17, and 18, Section 42, and Lots 2, 3, 4, and 5, Section 41, JRR:vmp:2- 7- 73:lst all in Flour Bluff & Encinal Farm and Garden Tracts in the City of Corpus Christi, Nuedes County, Texas, be and the same is hereby closed for public use and abandoned to the owners of the abutting property, to become effective upon the filing of an approved replat of the area involved, including drain- age easements necessary to take water from Flour Bluff Drive to the Oso, of such size and in such location as to, in the opinion of the Director of Engineering Services, provide for the flows contemplated in the Master Drain- age Plan. SECTION 2. The fact that the public convenience and necessity would be better served by the closing of the portions of street right of way as aforesaid creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordi- nance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this resolu- tion be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the r� day of February 1973.
