AN ORDINANCE
AUTHORIZING THE CITY MANAGER TO EXECUTE A
REAL ESTATE SALES CONTRACT FOR THE ACQUI-
SITION OF PARCEL NO. 40 OF THE SOUTH STAPLES
STREET PROJECT FROM PADRE ISLAND DRIVE TO
SARATOGA BOULEVARD, FROM THE OWNERS, PATRICIA
RAY PETERSON NUSS, JAMES D. PETERSON AND CHRISTY
PETERSON BROWN; APPROPRIATING OUT OF 220 STREET
BOND FUND $4,950 TO SUPPLEMENT FUNDS PREVIOUSLY
APPROPRIATED FOR THIS PARCEL BY ORDINANCE NO.
10784, ALL APPLICABLE TO PROJECT NO. 220 -70 -107;
AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the City Manager be, and he is
hereby, authorized to execute a real estate sales contract with
Patricia Ray Peterson Nuss, James D. Peterson and Christy Peterson
Brown, for the acquisition of Parcel No. 40 of the South Staples
Street Project from Padre Island Drive to Saratoga Boulevard,

Projt•ct No.`-220 -70 -107, said parcel being described as follows:
Being a 40 foot wide by 160 foot long strip
of land parallel to and abutting South Staples
Street (Dump Road) out of Lot 17, Sec. 13, Flour
Bluff and Encinal Fa -m and Garden Tracts as
recorded by map recorded in Vol. A, Pages 41,
42 and 43, Map Records of Nueces County, Texas,
and more particularly described by metes and
bounds as follows:
Beginning at the Northwest corner of said Lot 17;
thence S. 61° E. a distance of 20 feet; thence S.
291 W. a distance of 60 feet to a point for the
beginning point for this parcel;
Thence S. 611 E. a distance of 40 feet for a point;
Thence S. 29° W. along a line that is parallel to and
60 feet from the original center line of South Staples
Street (Dump Road) which is also the Northwest line
of said Lot 17, a distance of 160 feet to a point;
Thence N. 61° W. a distance of 40 feet to a point;
Thence N. 29° E. along a line that is parallel to
and 20 feet from said center line of South Staples
Street a distance of 160 feet to the point of begin-
ning and containing 6400 square feet of land more
or less.
SECTION 2. There is hereby appropriated out of No.
220 Street Bond Fund the sum of $4,950 to supplement funds
previously appropriated for this parcel by Ordinance No. 10784.

SECTION 3. The necessity to authorize the execution
of the necessary documents and to authorize the payment of- fu..ds
for the acquisition of the aforesaid parcel of land in order to
proceed with the development of the South Staples Street Project,
createG a public emergency an imperative public necessity requir-
ing the suspension of the Charter rule that no ordinance or reso-
lution shall be passed finally on the date of its introduction
and that such ordinance or resolution shall be read at three
several meetings of the City Council. and.the Mayor having
declares such emergency and necessity to exist, and having
requested the suspension of the Charter rule and that this
ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED, this the 1-,/--L/-
day of February, 1973.

BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCIL; 1, THEREFORE,
REQUEST THAT YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL. - -
