HomeMy WebLinkAbout11325 ORD - 02/21/1973AN ORDINANCE AMENDING ORDINANCE NO. 8879, CORPUS CHRISTI CITY CODE, 1958, KNOWN AS THE LAND DRILLING ORDINANCE, PASSED AND APPROVED BY THE CITY COUNCIL ON THE 29TH DAY OF MAY, 1968, AS AMENDED, SO AS TO REQUIRE A PERMIT TO REENTER A PRIOR PLUGGED AND ABANDONED WELL IN THE SAME MANNER AS THOUGH IT WERE A NEW WELL BY AMENDING SEC. 5.1, SEC. 6.23, AND SEC. 6.31(B) THEREOF TO SPECIFY SAID REQUIREMENTf PROVIDING FOR PUBLICATION; PROVIDING FOR S EVE RABILITY; AND DECLAR- ING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI TEXAS: SECTION 1. That Section 5.1, Ordinance No. 8879, Corpus Christi City Code, 1958, as amended, passed and approved by the City Council on the 29th day of May, 1968, be and the same is hereby amended by adding an addi- tional new sentence at the end of said section the following: "In addition to the other requirements of this section, a new permit is required to reenter any well which has been plugged and abandoned as though the plugged and abandoned well were a new well and it shall be unlawful for any person, acting either for himself or as an agent, employee, independent contractor or servant of any other person, to reenter such a well without first obtaining a permit therefor." SECTION 2. That Section 6.23, Ordinance'No. 8879, passed and approved by the City Council on the 29th day of May, 1968, as amended, be and the same is hereby amended by amending the first sentence thereof to hereafter read as follows: "All salt water produced from any oil or gas well shall be disposed of underground, provided a proper permit is obtained therefor in accordance with Section 5.1 of this ordinance, unless a permit to dispose of the water by some other method is approved by the Railroad Commission and where required, a revocable easement be obtained as provided in the City Ordinance adopted April 24, 1968, or such other regulatory ordinance as may be adopted pertaining to same." SECTION 3. That Section 6.31, Ordinance No. 8879, passed and approved by the City Council on the 29th day of May, 1968, as amended, be and the same is hereby amended by amending subparagraph B thereof to hereafter read as follows: "B. Wells in use as salt water or waste disposal wells which are operating under a valid permit from the govern- mental agency having authority, including but not limited to the permit required in Section 5.1 of this ordinance." 11325 0 SECTION 4. Publication shall be made one time in the official pub- lication of the City of Corpus Christi, after final passage, which publication shall contain the caption stating in substance the purpose of the ordinance. SECTION 5. If for any reason any section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 6. The necessity to make the above clarifications in the permit requirements of Ordinance No. 8879 creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its intro- duction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduc- tion and take effect and be in full force and effect from and after its passage andry publication, IT IS ACCORDINGLY SO ORDAINED, this the a2j/­'L day of Q7 z Q�7 , 1973.
