AN ORDINANCE
CLOSING TO PUBLI,C USE THE H.E.B. MUNICIPAL TENNIS
CENTER DURING THE UNIVERSITY OF CORPUS CHRISTI
COLLEGE TOURNAMENT (MARCH 2 AND 3, 1973) AND DURING
THE TRINITY MATCH (APRIL 22, 1973); PROVIDING FOR
CHARGING ADMISSION FEES TO SAID EVENTS; PROVIDING
FOR DIVISION OF FEES; AUTHORIZING AND DIRECTING THE
CITY MANAGER TO ENTER INTO AN AGREEMENT WITH UNIVERSITY
OF CORPUS CHRISTI REGARDING SAID EVENTS IN ACCORDANCE
WITH THE ATTACHED EXHIBIT "A "; AND DECLARING AN EMER-
GENCY.
WHEREAS, University of Corpus Christi proposes to hold a tennis
tournament at H.E.B. Municipal Tennis Center on March 2 and 3, 1973, and
April 22, 1973, and requests exclusive use of said Center during the conduct
of said tournaments 1 and
WHEREAS, in consideration of said use University of Corpus Christi
offers to collect admission fees from spectators and remit Twenty -Five Per-
cent (258) of fees collected to the City; and
WHEREAS, such tournaments will be of benefit to the citizens of
this City and promote athletics and sportsmanship at University of Corpus
Christi as well as in the City; and
WHEREAS, the City Council finds that granting the use of said Center
under the terms and conditions herein will be of benefit to the citizens of
the City and to University of Corpus Christi and is in the best public interest
by promoting public health among citizens:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CORPUS CHRISTI, TEXAS:
SECTION 1. That the H.E.B. Municipal Tennis Center is closed to
the public for the exclusive use of the University of Corpus Christi for the
conduct of an intercollegiate tennis tournament under the terms and conditions
herein during the following times for the following tennis tournaments:
U.C.C. College Tournament - March 2, 1973, Center closed
from 1:30 to 4:30 P.M. - Semi- finals
March 3, 1973, Center closed
from 1:30 to 4:30 P.M. - Finish
Trinity Match - April 22, 1973 - Center closed from 1:30 to 4:30 P.M.
SECTION 2. That University of Corpus Christi is hereby authorized
to charge admission fees to spectators in the Semi- finals and Finals in the

University of Corpus Christi College Tournament and for the Trinity Match in
accordance with the terms and conditions herein. The charges authorized to
be charged are as follows:
Adults $1.50
Children 18 and under $ .75
Children 6 and under No charge
U.C.C. students admitted at no charge upon presentation of their
Student Activity Card.
University of Corpus Christi will handle the printing and selling of tickets
and all related expenses subject to inspection of the records of receipts by
the City. The gross receipts from such admission charges authorized herein
will be distributed Seventy -five Percent (75 %) to University of Corpus Christi
and Twenty -five Percent (25 %) to the City to be deposited in the City's General
Revenue Fund.
SECTION 3. That the City Manager be and is hereby authorized and
directed, for and on behalf of the City, to execute the attached agreement with
the University of Corpus Christi regarding the terms and conditions herein,
said attachment being marked Exhibit "A" and made a part hereof the same as if
written herein.
SECTION 4. The necessity to promote the public health furthered by
the tennis tournaments hereinabove provided for and to advance the public
awareness of athletics and sportsmanship creates a public emergency and an
imperative public necessity requiring the suspension of the Charter rule that
no ordinance or resolution shall be passed finally on the date of its intro-
duction but that such ordinance or resolution shall be read at three several
meetings of the City Council, and the Mayor having declared such emergency
and necessity to exist, and having requested the suspension of the Charter
rule and that this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after its passage,

WHEREAS, the University of Corpus Christi proposes to sponsor the
University of Corpus Christi College Tournament on March 2 -3, 1973, and the
Trinity Match on April 22, 1973, at H.E.S. Municipal Tennis Court and desires
exclusive use of such Center and to charge certain admission fees for spec-
tators; and
WHEREAS, Ordinance No. , passed and approved by the
City Council on February 28, 1973, closed said Center for such tournaments,
authorized the charging of such admission fees, and authorized the execution
of this agreement.
NOW, THEREFORE, for and in consideration of the payments, under-
takings, and covenants herein, the City of Corpus Christi, a municipal corpo-
raticn and body politic under the laws of the State of Texas, acting by and
through its duly authorized City Manager, hereinafter called "City" and the
University of Corpus Christi, hereinafter called "U.C.C. ", covenant, agree,
and contract as follows:

The City agrees to close to the public for the exclusive use of
the University of Corpus Christi for the conduct of the following intercol-
legiate tennis tournaments under the terms and conditions herein during the
following times for the following tennis tournaments:
U.C.C. College Tournament - March 2, 1973, Center closed
from 1:30 to 4:30 P.M. - Semi- finals
March 3, 1973, Center closed ✓
from 1:30 to 4:30 P.M. - Finish
Trinity Match - April 22, 1973 - Center closed from 1:30 to 4:30 P.M.

The City agrees to post a notice of the upcoming match at the Center
at least one week prior to each of the matches contemplated herein giving the
dates, times, and charges involved.

That University of Corpus Christi is hereby authorized to charge
