VOLUME 9, PAGES 565, ET SEQ, OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME AND PARTICULARLY AS AMENDED BY ORDINANCE NO. 6106, AS AMENDED, UPON APPLICATION OF WOOLDRIDGE & COMPANY, BY AMENDING THE ZONING MAP BY CHANGING THE ZONING ON TRACT 1 FROM "F -R" FARM -RURAL DISTRICT TO "B -4" GENERAL BUSINESS DISTRICT; AND CHANGING THE ZONING ON TRACT 2 FROM "F -R" FARM -RURAL DISTRICT TO "A -1" APARTMENT. HOUSE DISTRICT, BOTH TRACTS BEING OUT OF LOTS 17, 18 AND 19, SECTION 12, FLOUR BLUFF & ENCINAL FARM & GARDEN TRACTS, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS; KEEPING IN EFFECT ALL OTHER PROVISIONS OF THE EXISTING ORDINANCE AS AMENDED; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND DECLARING AN EMERGENCY. WHEREAS, THE PLANNING COMMISSION HAS FORWARDED TO THE CITY COUNCIL ITS REPORTS AND RECOMMENDATIONS CONCERNING THE APPLICATION] OF Wooldridge & Company. FOR AMENDMENT TO THE ZONING MAP OF THE CITY OF CORPUS CHRISTI; AND IrriEREAS, PUBLIC HEARING WAS HELD AT WHICH HEARING ALL PERSONS WISHING TO 4PPEAR AND BE HEARD WERV HEARD, TO CONSIDER THE SAME BEFORE: THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, IN ACCORDANCE WITH 1--ER NOTICE 1.0 THE PUBLIC, SAID PUBLIC HEARING HAVING BEEN HELD,ON Wednesday, March 7, 1973 , AT_stlecial COUNCIL MEETING OF THE CITY COUNCIL IN THE COUNCIL CHAMBER AT CITY HALL IN THE CITY OF CORPUS CHRISTI; AND WHEREAS, BY MOTION DULY MADE, SECONDED AND CARRIED, IT WAS DECIDED BY THE CITY COUNCIL THAT TO APPROVE THE HEREINAFTER SET FORTH AMENDMENT WOULD BEST SERVE PUBLIC HEALTH, NECESSITY AND CONVENIENCE AND THE GENERAL WELFARE OF THE CITY OF CORPUS CHRISTI AND ITS CITIZENS: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT THE ZONING ORDINANCE OF THE CITY OF CORPUS CHRISTI, TEXAS, PASSED ON THE 27TH DAY OF AUGUST, 1937: APPEARING OF RECORD IN VOLUME 91 PAGES 565, ET SEQ¢ OF THE ORDINANCE AND RESOLUTION RECORDS, AS AMENDED FROM TIME TO TIME, AND IN PARTICULAR AS AMENDED BY ORDINANCE No. 6106, AS AMENDED, BE AND TIIC SAME IS HEREBY AMENDED BY MAKING THE CHANGE HEREINAFTER SET OUT. ]11346 t; o SECTION 2. That the zoning of Tract 1, being out of the northeast one -half of Lot 170 Section 12, Flour Bluff and Encinal Farm and Garden Tracts, save and except a tract 420 feet x 210 feet out of the north corner of Lot 17, Section 12, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, be and the same is hereby changed from "F -R" Farm -Rural District to "B -4" General Business ; District; and changing the zoning of Tract 2, being out of the northeast one -half of Lots 18 and 19, Section 12, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, be changed from "F -R" Farm -Rural District to "A -1 Apartment House District; said Tracts 1 and 2 are hereinafter more fully described as follows: The Northeast 1/2 of Lots 17, 18 and 19, Section 12, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, according to plat recorded in Volume A, pages 41 -43, of the Map Records of Nueces County, Texas; SAVE AND EXCEPT a tract 42C/ x 210' out of the North corner of Lot 17, Section 12, Flour Bluff & Encinal Farm and Garden Tracts, Nueces County, Texas, described as follows: BEGINNING at the north corner of Lot 17, Section 12, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, which point is at the intersection of the center lire of South Staples Street, with the center line of a 40' county road known as Woolridge Road, for the north corner of the tract herein being described; THENCE S. 6T'00''40" E., with the north- east boundary of said Lot 17, which is also the center line of said Woolridge Road, a distance of 420.0' to a point for the east corner of this tract; THENCE S. 29° 00' W ..,- - parallel to the northwest boundary of said Lot 17, at 20.0' pass a 5/8" iron rod set in the southwest boundary of said Woolridge Road, in all a distance of 210.0' to a 5/8" iron rod set 12" deep for the South corner of this tract; THENCE N. 61° 00' 40" W. parallel to the northeast boundary of said Lot 17, at 210.0' pass a 1 1/4" iron pipe 12" deep, at 380.0' pass a 1 1/4" iron pipe flush, in all a distance of 420.0' to a point in the center line of South Staples Street which center line is also the northwest boundary of said Lot 17, for the west corner of this tract; THENCE N. 29° E. with the center line of South Staples Street which is also the Northwest boundary of said Lot 17, a distance of 210.0' to the North corner and place of beginning. SECTION 3. THAT THE OFFICIAL ZONING MAP OF THE CITY OF CORPUS CHRISTI, TEXAS, DE, ANO THE SAME IS HCREDY, AMENDED AS IICREIN ORDAINED. SECTION 4. THAT THE 7014ING ORDINANCE AND MAP OF TILE CITY OF CORPUS CIIr IST1, TEXAS, APPROVED 0:4 TILE 27TfI DAY OF AUGUST, 1937, AS AMENDED FROM TIME 1 -0 TIMC, EXCEPT AS HEREIN CHANGED, SHALL RCMAIN IN FULL FORCI: AND CFFECT. SECTION 5. TfIAT ALL ORDINANCES OR PARTS OF ORDINANCES IN CON- FLICT HERLWITH ARE DCRCDY EXPRESSLY I:EPEALCD. -2- v O SECTION 6. THAT TH£ NECESSITY OF IMMEDIATELY MAKING AFORESAID CHANGE FOR THE PURPOSE OF MAINTAINING AT ALL TIMES A COMPREHENSIVE.20NING ORDINANCE FOR THE CITY OF CORPUS CHRISTI CREATES A PUDLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED THAT SUCH EMERGENCY AND NECESSITY EY,IST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE DE PASSED FINALLY ON TtC: DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, THIS THEY_DAY OF ,ATTEST- c.
