HomeMy WebLinkAbout11360 ORD - 03/14/19733 /14 /73:JRR:vp:2d AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER TO ACCEPT DELIVERY OF AND TO RECORD DEED FROM THE UNIVERSITY OF CORPUS CHRISTI, A COPY OF THE SUBSTANTIAL FORM OF WHICH IS ATTACHED HERETO, YARNED EXHIBIT "A ", AND MADE A PART HEREOF FOR ALL PERTINENT PURPOSES; AUTHORIZING AND DIRECTING THE CITY MANAGER TO DELIVER DEED TO TEXAS A & I UNIVERSITY AT CORPUS CHRISTI OF ALL PROPERTY DESCRIBED IN DEED FROM THE UNIVERSITY OF CORPUS CHRISTI, A COPY OF THE SUBSTANTIAL FORM OF WHICH IS ATTACHED HERETO, MARKED EXHIBIT "B ", AND MADE A PART HEREOF FOR ALL PERTINENT PURPOSES, IN ORDER TO ESTABLISH AN UPPER LEVEL COLLEGE IN CORPUS CHRISTI; AUTHORIZING AND DIRECT- ING THE CITY MANAGER TO EXECUTE AND DELIVER ALL OTHER INSTRUMENTS NECESSARY TO EFFECT SAID CONVEYANCES SO LONG AS THE CITY'S TOTAL OBLIGATION AND LIABILITY THEREUNDER DOES NOT EXCEED $1,500,000; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TES: SECTION 1. That the City Manager be and he is hereby authorized and directed to accept delivery of and to record Deed from the University of Corpus Christi, a copy of the substantial form of which is attached as Exhibit "A ", and made a part hereof for all pertinent purposes; authorizing and - directing the City Manager to deliver Deed to Texas A & I University at Corpuv Christi of all property described in Deed from the University of Corpus Christi, a copy of the substantial form of which is attached as Exhibit "B ", and made a part hereof for all pertinent purposes, in order to establish an Upper Level College in Corpus Christi; and authorizing and directing the City Manager to execute and deliver all other instruments necessary to effect said conveyances so long as the City's total obligation and liability there- under does not exceed $1,500,000, exclusive of title and closing costs. SECTION 2. The necessity to effect delivery of the aforesaid Deeds at the earliest practicable date in order to establish an�Upper Level College • of the State of Texas in Corpus Christi creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having-,requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its 11360 introduction and take effect and be in full force and effect from and after its passage, IT IS ACCORDINGLY SO ORDAINED, this the L * day of March, 1973.
