AN ORDINANCE. >r• > AMENDING ORDINANCE NO. 10535, PASSED AND APPROVED ON OCTOBER 27, 1971, SO AS TO CORRECT THE DESCRIPTION OF AREA ABUTTING THE PORTION OF MOORE STREET W-11CH WAS CLOSED BY SAID ORDINANCE; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. THAT ORDINANCE ND. 10535, PASSED AND APPROVED BY THE CITY COUNCIL ON OCTOBER 27, 1971, BE AND THEE SAME IS HEREBY AMENDED IN THE FOLLOWING RESPECTS: WHEREVER BLOCKS 7 AND 8, SUNNYSIDE ADDITION, IS WRITTEN, IT SHALL HEREAFTER BE CHANGED TO "BLOCKS 7 AND 8, JOHN G. HATCH ADDITION". Th!EREFORE, IN ADDITION TO CHANGES IN THE CAPTION AND FIRST PREAMBLE PARAGRAPH' > ^ OF SAID ORDINANCE NO. 10535, SECTION 1 OF SAID ORDINANCE WILL HEREAFTER READ AS FOLLOWS: ` "SECT .I ON 1. THAT MOORE STREET BETWEEN BLOCKS 3 AND 4, SUNNYSIDE ADDITION, AND BETWEEN BLOCKS 7 AND H, JOHN G. HATCH ADDITION, SITUATED IN THE CITY OF CORPUS CHRISTI IS HEREBY CLOSED FOR PUBLIC USE AS A PUBLIC STREET AND ABANDONED TO THE OWNERS OF THE ABUTTING PROPERTY, SUBJECT TO THE HEREINAFTER PROVIDED CONDITIONS: - 1. THAT ABUTTING PROPERTY OWNERS BE RESPONSIBLE FOR ELIMINATING ANY EXISTING STREET OR STREET AREAS; t 2. THAT CURBS, GUTTERS AND SIDEWALKS BE EXTENDED ACROSS THE EXISTING STREET AT ABUTTING PROPERTY OWNERS' EXPENSE; AND t 3. THAT AN EASEMENT FOR ALL UTILITIES IN THE FULL WIDTH OF THE RIGHT OF WAY OF THE HEREINABOVE DESCRIBED PROTION OF MOORE STREET BE RETAINED AND RESERVED TO THE CITY, AND THIS CLOSURE IS CONDITIONED ON SUCH RESERVATION BEING EFFECTED A'.D PRESERVED. . - IN THE EVENT ANY RESERVATION OF EASEMENT HEREIN MADE BY THIS CLOSING IS NULLIFIED, INVALIDATED OR REVOKED BY ANY LEGAL AUTHORITY OR BY FINAL JUDG- MENT CF .A COURT OF COMPETENT JURISDICTION, THIS CLOSURE IS THEREBY VOIDED TO THE EXTENT OF SUCH RCVOCATION OR INVALIDATION OF EASEMENT." .. t SECTION 2. THE NECESSITY TO CORRECT THE DESCRIPTION OF THE PROPERTY ABUTTING THE STREET WHICH WAS CLOSED BY ORDINANCE N0. 105535 AT THE EARLIEST POSSIBLE DATE, CREATES A PUBLIC EMERGENCY AND AN IMPERATIVE PUBLIC NECESSITY REQUIRING THE SUSPENSION OF THE CHARTER RULE THAT NO ORDINANCE OR RESOLUTION - SHALL BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION BUT THAT SUCH ORDINANCE OR RESOLUTION SHALL BE READ AT THREE SEVERAL MEETINGS OF THE CITY COUNCIL, AND THE MAYOR HAVING DECLARED SUCH EMERGENCY AND NECESSITY TO EXIST, AND HAVING REQUESTED THE SUSPENSION OF THE CHARTER RULE AND THAT THIS ORDINANCE` BE PASSED FINALLY ON THE DATE OF ITS INTRODUCTION AND TAKE EFFECT AND BE IN FULL FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, IT IS ACCORDINGLY SO ORDAINED, ; THIS THE - I-J; DAY OF MARCH, 1973• ATTEST: G 0 CITY SECRETA IAA THE CITY OF ORP HRIS I, TEXAS APPROVED: Y 0 MARCH, 1973: )a'E7'//-D y TT Y Y 4 .
