HomeMy WebLinkAbout11386 ORD - 03/21/1973• JRR:e:3 /21/73 1st • AN ORDINANCE CLOSING THE ALLEY WHICH RUNS FROM NEAL STREET TO GULFSPRAY AVENUE, THROUGH BLOCK 18, IN BROOKLYN ADDITION, WHICH ALLEY RUNS PARALLEL TOONORTH SHORELINE BOULEVARD AND GULFBREEZE BOULEVARD, IN THE CITY OF CORPUS CHRISTI, NUECES COUNTY, TEXAS, SUBJECT TO SAID BLOCK 18 BEING REPLATTED AS ONE LOT AND SUBJECT TO THE EXISTING SEWER LINE IN SAID ALLEY BEING ABANDONED IN PLACE AND PLUGGED, OR USED IF NO INFILTRATION; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. WHEREAS, notice of the time and place for holding a hearing concerning the closing of an alley which runs from Neal Street to Gulfspray Avenue through Block 18, in Brooklyn Addition, which alley runs parallel to North Shoreline Boulevard and Gulf - breeze Boulevard, was given by publication and mailed to the last known addresses of the owners of property abutting said alley and within 450 feet of the area to be closed and thereafter, pursuant to said notice, public hearing was held at Regular Meeting of the City Council of the City of Corpus Christi on Wednesday, March 14, 1973, in accordance with the provisions of the City Charter; and WHEREAS, it was determined by the City Council.•.after such hearing that it would best serve the public convenience and necessity to close said alley as that portion of the alley is not now needed for alley purposes, nor will it, within the foresee- able future be needed as a public alley; and WHEREAS, it has been determined that it is to the advantage of the City to close the above described alley so that the same may be used by the abutting property owners for other purposes, subject to said Block 18 being replatted as one lot and subject to the existing sewer line in said alley being plugged and abandoned in place, or used if no infiltration: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the alley which runs from Neal Street to Gulfspray Avenue, through Block 18 of Brooklyn Addition (which 11386 • • alley runs parallel to North Shoreline Boulevard and Gulfbreeze Boulevard), situated in the City of Corpus Christi, Nueces County, Texas, be aid the same is hereby closed for public use and abandoned to the owners of the abutting property, subject to said Block 18 being replatted as one lot, and subject to the existing sewer line being plugged and abandoned in` place, or used if no infiltration. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect. SECTION 3. The fact that the public convenience and necessity would be better served by the closing of the said street as aforesaid creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolution shall be passed finally on the date of its introduction and that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared such emergency and necessity to exist, and having requested the suspension of the Charter rule and that this ordi- nance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage IT IS ACCORDINGLY SO ORDAINEDI Ier �e,�L-,-- day of March, 1973.
