HomeMy WebLinkAbout11388 ORD - 03/21/1973JRR:jk}1:3- 21 -73; 1st AN ORDINANCE AMENDING SECTION _21 -2 OF THE CORPUS CHRISTI CITY CODE, CHAPTER 21, ARTICLE I, BY AMENDING THE DEFINITION OF "SCHOOL ZONE" SO AS TO DELETE REFERENCE TO INITIALS "M.P.H." FROM SCHOOL ZONE SIGNS AND DELETING REFERENCE TO PAINTING ZONE LIbaTS ON THE PAVEMENT; PROVIDING SEVERABILITY; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. � N BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That Chapter 21, Article I, of the Corpus Christi City Code-be amended by amending Section 21 -2, Definitions, by deleting the present definitionof "School Zone" and in lieu thereof adopting the definition as set forth hereinafter: "School Zone. Each street, alley, and public ground, or part thereof, within two hundred and fifty feet (250') of the nearest property line of any school, public or private, having a regular average attendance of one hundred and fifty (150) pupils, whereabout signs or markers bearing the words 'School Zone. 15' shall have been erected an ?, °are conspicuously displayed on such street, alley, or ground indicating the approach to the boundary line of such school zone. By the erection of a sign or marker with the foregoing designation, a legal school zone shall be established. Signs bearing the words 'End School Zone' shall be erected at each end of such school zone giving notice to motorists that safe driving speeds may be resumed." SECTION 2. If for any reason any sectioq paragraph, subdivision, clause, phrase, word, or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction it shall not affect any other section, paragraph, subdivision, clause, phrase, word, or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. 14388 • 0 SECTION 3. Publication shall be made one time in the official Publication Of the City of Corpus Christi, by publishing the caption of this ordinance, stating in substance the purpose of the ordinance. SECTION 4. The necessity to amend the City Code as hereinabove set forth in order to provide uniform signalization for school zones in the City creates a public emergency and an imperative public necessity requiring the suspension of the Charter rule that no ordinance or resolu- tion shall be passed finally on the date of its introduction but that such ordinance or resolution shall be read at three several meetings of the City Council, and the Mayor having declared that such emergency and necessity exist, and having requested the suspension of the Charter rule and that this ordinance be passed finally on the date of its introduction and take effect and be in full force and effect from and after its passage and publication, IT IS ACCORDINGLY SO ORDAINED, this th �� day of March, 1973.
