AN ORDINANCE
CLOSING THAT PORTION OF WINNEBAGO STREET
LOCATED AT THE INTERSECTION OF KENNEDY AND
WINNEBAGO STREETS, BEING A PORTION OF THE
SOUTH ONE -HALF OF THE ORIGINAL PEARSALL
STREET ABUTTING LOT 1, BLOCK 1, CITIZENS
ADDITION, MORE FULLY HEREINAFTER DESCRIBED,
SUBJECT TO THE RETENTION BY THE CITY OF A
10 -FOOT UTILITY EASEMENT WHERE EXISTING
UTILITY LINES ARE NOW LOCATED; PROVIDING
FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, notice of the time and place for holding a
hearing concerning the closing of a portion of Winnebago Street,
being that portion at the intersection of Kennedy and Winnebago
Streets which abuts Lot 1, Block 1, Citizens Addition, was given
by publication and mailed to the last known address of the owners
of property abutting said street and within 450 feet of the area
to be closed and thereafter, pursuant to said notice, public
hearing was held at Regular Meeting of the City Council of the
City of Corpus Christi on Wednesday, March 21, 1973, in accordance
with the provisions of the City Charter; and
WHEREAS, it was determined by the City Council after
such hearing that it would best serve the public convenience and
necessity to close the street within the limits hereinabove set
forth, and more fully described hereinafter, for use as a public
street, subject to retention of a 10 -foot utility easement where
an existing water line is now located:
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That the hereinafter described portion of
Winnebago Street, being that portion located at the intersection
of Kennedy and Winnebago Streets (a portion of the south one -half
of the original Pearsall Street abutting Lot 1, Block 1, Citizens
Addition) be and the same is hereby closed for use as a public
street and abandoned to the owner of the abutting Lot 1, Block 1,
Citizens Addition, subject to the retention by the City of a
10 -foot utility easement where an existing water line is now
located, said portion hereby closed being more particularly
described as follows:
Being a portion of Winnebago Street lying between
Lot 1, Block I, and Lot 11,.Block II, Citizen's
Addition as shown by map of record in Volume A,
Page 6, Map Records, Nueces County, Texas, said
portion of Winnebago Street being more particularly
described by metes and bounds as follows:
Beginning at the most northerly corner of said Lot 1,
for the most westerly and beginning corner of the
tract herein described;
Thence N. 300 31' 20" E., with the Northeasterly
extension of the Northwest line of said Lot 1, a
distance of 21.98 feet to a point, the P.C. of a
curve for a corner of the tract herein described;
Thence in a northeasterly direction with the arc
of a curve to the right whose central angle is
141 03' 56 ", and whose radius is 33.0 feet, an
arc distance of 8.10 feet to a point for the most
northerly corner of the tract herein described;
Thence S. 590 30' E., with the centerline of
Winnebago Street, a distance of 90.10 feet to a
point in the arc of a curve for a corner of the
tract herein described;
Thence in a Southeasterly direction with the arc
of a curve to the left whose central angle is 50
35' 40" and whose radius is 572.92 feet, an arc
distance of 55.94 feet to a point, the most easterly
corner of the tract herein described;
Thence S. 30° 31' 20" W., with the Northeasterly
extension of the Southeast line of said Lot 1, a
distance of 15.11 feet to a point, the most easterly
corner of said Lot 1, and the most southerly corner
of the tract herein described;
Thence N. 59° 30' W., with the Northeast line of
said Lot 1, a distance of 145.0 feet to the point of
beginning.
Containing 3,951.0 square feet of land more or less.
SECTION 2. If for any reason any section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance
shall be held invalid or unconstitutional by final judgment of
a court of competent jurisdiction it shall not affect any other
section, paragraph, subdivision, clause, phrase, word or provision
of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase,
word, or provision hereof be given full force and effect.

SECTION 3. The fact that the public convenience and
necessity would be better served by the closing of the said
street as aforesaid creates a public emergency and an imperative
public necessity requiring the suspension of the Charter rule
that no ordinance or resolution shall be passed finally on the
date of its introduction and that such ordinance or resolution
shall be read at three several meetings of the City Council, and
the Mayor having declared such emergency and necessity to exist,
and having requested the suspension of the Charter rule and that
this ordinance be passed finally on the date of its introduction
and take effect and be in full force and effect from and after
its passage, IT IS ACCORDINGLY SO ORDAINED,this_ the 28th day of
March, 1973.

BE PASSED FINALLY ON THE DATE IT IS INTRODUCED, AND THAT SUCH ORDINANCE OR
RESOLUTION SHALL BE READ AT THREE MEETINGS OF THE CITY COUNCILS I, THEREFORE,
REQUEST THp7 YOU SUSPEND SAID CHARTER RULE OR REQUIREMENT AND PASS THIS ORDI-
NANCE FINALLY ON THE DATE IT IS INTRODUCED, OR AT THE PRESENT MEETING OF THE
CITY COUNCIL.
