This agreement is authorized by Ordinance No.
and is entered
into between the City of Corpus Christi, Texas, a municipal corporation and
body politic operating under the home rule statute of the State of Texas,
hereinafter called "City" and Texas Eastern Transmission Corporation, and
pertains to the construction of the Clarkwood Ditch, a joint City -State project
within the city limits of Corpus Christi, and the protection of existing
utilities crossing the Clarkwood Ditch existing in right of way recently
acquired by the City for the Clarkwood Ditch drainage project.
W I T N E S S E T H I
WHEREAS, Texas Eastern Transmission Corporation has been requested by
the City to provide adequate protection for their 30" transmission line for
the future excavation of the Clark-wood Ditch in the joint City -State drainage
project; and
WHEREAS, Texas Eastern Transmission Corporation and the City have
determined a safe and reasonable means of protection for said 30" line; and
WHEREAS, the City has agreed to reimburse Texas Eastern Transmission
Corporation for applicable expenses incurred in providing said protection;
NOW, THEREFORE, the City and Texas Eastern Transmission Corporation
agree as follows;
1. Texas Eastern Transmission Corporation will provide protection to
their 30" transmission line as shown on Texas Eastern Transmission Corporation
drawing No. TF- 4- 189.1, a print of which is attached hereto and made a part
hereof.
2. Texas E;istern Transmission Corporation will construct such protec-
tion with their own forces and will begin such construction by June 15, 1973.
3. The City will pay Texas Eastern Transmission Corporation for costs
incurred as set out in the stst(VIOnt of work and cost estimate furnished by
Te> ;ns E;isL•ern Transmission Corporation, a copy of which is attached hereto and
made a part hereof.

Y place a concrete lining atop the Texas Eastern •
Transmission Corporation's 30" line when the Clarkwood Ditch is excavated,
said concrete lining being as shown on the attached drawing prepared by the
Department of Engineering Services, City of Corpus Christi. Said lining to
be paid for by the City.
5. The City will provide inspectional services both for inspectional
Purposes and for tabulating material, labor and equipment costs incurred by
Texas Eastern Transmission Corporation.
6. The City will reimburse Texas Eastern Transmission Corporation an
estimated $22,670.00, based on the final work and costs incurred by Texas
Eastern Transmission Corporation.
7. The City also agrees to reimburse Texas Eastern Transmission
Corporation $4,677.42 for preparatory investigative work in uncovering
approximately 100 linear feet of the 30" line in November, 1972.
8. This agreement shall be executed in two (2) copies, each of which
shall be considered an original, and which shall become effective and be
binding upon and inure to the benefit of the parties hereto and their respective
heirs, successorf, and assigns.

STATEMETNT OF WORK TO BE PERFORMED
The following Statement of Mork covers all work to be performed by
Texas Eastern Transmission Corporation in connection with the proposed
Clarkwood Ditch which crosses Texas Eastern's 30" Line 116 at M.P. 130.59;
Nueces County, Texas.
The existing 30" pipeline must have approximately 80 feet of 36" O.D.
casing installed and must be supported by two supports constructed of
12 diameters x 40' piling and 2" x 12" x 5' -6" cross girders to comply
with company policy, Texas Highway Department specifications, and City
of Corpus Christi specifications. This adjustment will allow construc-
tion of the Clarkwood hitch which is a joint venture between the City
of Corpus Christi, Nueces County, and the Texas Highway Department.
The alterations will be performed as shown on the attached Drawing
TF -4- 189.1, Sheet 1 of 1.
The proposed work will consist of Texas Eastern's moving in equipment
and material to the job site; digging the ditch and installing the two
pipe supports; installing insulators, end seal, and casing; digging out
the upstream end of existing casing, installing a new end seal, and
installing a 411- casing vent with Type T Corrosion Test Site; removing
the existing 4" downstream vent; back£illing and cleaning up the job
site; Moving out equipment; and preparing as -built drawings and comple-
tion reports. It is estimated that the total time required for the
entire actual field work, including move -in and move -out, will be a
total of 12 ten -hour working days.
The utility adjustment work will be performed by Texas Eastern company
personnel. In the event that company equipment is not available,
rental equipment will be obtained at the "going rate" and this rate
will be invoiced in the final billing. The final billing will reflect
all preliminary charges accumulated on O.W.P. #0850 in addition to the
attached work order estimate of $22,670, said work order to reflect
actual costs incurred.
Texas Eastern will request reimbursement for the actual costs encountered.
Upon receipt of invoice the City of Corpus Christi is requested to pay
the full amount without undue delay. If exceptions are found, then the
City of Corpus Christi is requested to pay 90% of said invoice without
undue delay. Invoice will be prepared in triplicate and submitted to:

The City Council of Corpus Christi is requested to approve this State-
ment of Work, Cost Estimate, and Plans to protect the 30" pipeline
as shown on Drawing TF -4- 189.1, and to forward Council minutes to
Baytown Office before construction will be scheduled.
